SLASH On 'Chinese Democracy' Leaker: 'I Hope He Rots In Jail'

According to the Los Angeles Times, GUNS N' ROSES and the group's former guitarist Slash have commented on the arrest of a California man on copyright-infringement charges for posting on his web site nine songs from GUNS N' ROSES' yet-to-be-released album "Chinese Democracy". Kevin Cogill (a.k.a. Skwerl), 27, is accused of posting the songs, which were being prepared for commercial release, on the Internet blog Antiquiet in June. The site crashed under the traffic, and he removed the songs after a few hours when the Los Angeles-based rock band's lawyers complained. Now he faces up to three years in prison and $250,000 in fines. On Wednesday he became the first Californian charged under a 3-year-old federal anti-piracy law that makes it a felony to distribute a copyrighted work on computer networks before its release. "I hope he rots in jail," Slash told the Los Angeles Times. "It's going to affect the sales of the record, and it's not fair. The Internet is what it is, and you have to deal with it accordingly, but I think if someone goes and steals something, it's theft." GUNS N' ROSES released a statement: "Presently, though we don't support this guy's actions at that level, our interest is in the original source. it's funny, because the demos to that crap album was leaked out on Torrentspy about a year ago. I had it downloaded and it's terrible!
I mean awful!
And granted I am not a GNR fan, but the demos were absolutely awful compared to their back catalog.

But now that this has happened, the guy gets what he deserves... And I agree with what Slash says.
I've only heard "some" of the songs of the album on the radio.. But that's about it . . .

This goes back to when Lars Ulrich took the Napster issue to US Senate and the ruling was that Napster be shut down and all users found downloading music be charged and possibly sent to jail. That was back in 2000. It was all because Metallica was working on I Disappear for the MI:2 soundtrack and it was leaked even before it was done and released and I don't blame Lars on that. However, it alienated many of Metallica's fans and the result was in a total fan boycott in Metallica's music and the loss of alot of fans worldwide. But If I had say $1 Million in the bank and someone stole $100, I wasn't losing much. So if Metallica lost 100 fans out of 1 million, they weren't losing much. Jump ahead from 2000, three years to the much anticipated release of St. Anger. New Metallica album. Napster is back by this time as a PAY download site and many of its offspring such as Bearshare, Shareaza, Ares, Limewire and others offer a free version of said sites as well as a premium pay verion where users can pay and get full usage of all said sites. St. Anger was so highly anticipated that in the even of songs being leaked, as this time St. Anger the song itself was already the lead single off the album, the band decided to bump up the release of the album ahead 5 days from Tuesday June 10th to Thursday June 5th, 2003. Then St. Anger tanked big time and most Metallica fans were skeptical of seeing what they could do next. 5 years later, Death Magnetic, they are streaming full songs as well as clips of songs on their website and the Mission Metallica site, where fans can preview the album before it's done. Well since Tuesdays come in the middle of the week and most people don't get paid until Fridays, what better day than a Friday to release a new album where fans can get digital versions and anything else for Death Magnetic. Also, the entire album will be available for download on the day it is released for Guitar Hero 3. So if new GnR tunes are being leaked, and they don't want it to be leaked until it's released, it will alienate fans, risk the bigger chance of it being leaked even before a release date is even announced and fans will have the entire album in their hands before the band can release it. So if songs are being stolen, yes he should be in jail because it's theft. If he is just a part of management or something giving fans a taste of new music without permission, then go for it he's not doing anything. He didn't steal them, the band knew he has them but can't stop him from doing as he wishes with them. This guy previously worked with the record company and was given the songs. He simply took what was given to him and posted them on line. "accused of posting the songs, which were being prepared for commercial release" from the above story but the original story from back in June states that he was the middle man between "a reliable source and someone who was very angry" He was given the songs from his "reliable soure" but when it was found out that he did as he pleased with them, "someone very angry" got pissed off about it and called the authorities.

He put them up for free. I really don't think it'll hurt the album's sales. If an album is good, people will buy it. Beyond that, people who don't care about Guns N Roses will continue to not care about Guns N Roses.
But Slash sounds a little dumb saying this shit. It's funny that this dude is in jail, while Bin Laden is still out there somewhere (probably in Appalachia somewhere)...

As a huge vinyl freak myself, you can guess that I fucking love to get the LP, take off the seal, smell it (yes, they smell!!! 01010101010101010101's don't smell!!!!!!), look a t the cover and lyrics, put it on, light one up or open a cold ice one, and listen. THE RITUAL.
I download records. Of course. But there are many of those that I don't listen to just because I know someday I am going to buy them. Therefore I prefer the experience related above: THE RITUAL. Or I download records I already have so I can put them on a digital form and take them away when I travel: I have tried to put a vinyl in my car, but after a few turns, it gets disgusting.
So, I have voth sides of the story here.
Internet has been such a joy for me, because I have been able to download records that are lost gone in many catalogs or rarities 10 years ago I only could dream of getting anyday, like pre ELF era DIO (DIO AS A CROONER ON The Domino's !!!!!)
I think is wrong to download every fucking thing you hear or see around in an advertisement. Like many kids do nowadays. They even think they have the right to do it, but they are stealing. Tape trading is not even close to this. Don't mention that. With tape trading a few albums were copied by each fan. Nowadays you can download 10 albums in 10 minutes.

i agree he should go to jail, song theeft is a theft just like ay other theft!!! dont matter if the band is GNR or any other band. people can just buy music like they used to do. but i must admit i have donwloaded albums but usually old albums i wanna check out and then i buy them and also new albums that i cant wait to get out and then i buy them but we should just wait for an album to come out. and the new GNR songs seem to be very good and they aret even finsihed and i saw Axl twice and he ery good oth times and the new songs were very good live too. And sales today have nothing to do with how good an album is. and so what Slash used to do heroin, he's not the only one and most of the best artist and famous people throughout history have been drug users and drunks sometimes in their lives!

hell, they were probably not too dissapointed when they found out about this, it probably helped spike the hype up even more. these people need to get over their own egos. all hes concerned about is money, and sure i would be angry as well if i lost album sales, but 1- theyre FRICKEN LOADED ALREADY 2-if they didnt wait an eon to release the album, this wouldnt have happened
and FINALLY its their own fault for hyping it so much for such a long period of time. they were/are publicizing it without a definate release anytime soon. they know exactly what they are doing so they should shut up, they arent fooling anyone.

In late 2000/2001 Napster pretty much hit its peak. Everyone was doing it, this being that time time period before Lars and James stood up for their fellow musicians. At that time 3 Doors Down released their debut album, which end up selling a couple million copies. Not bad, but at that time 2 million copies wasn't really a hell of a lot. What came out later, was that another 5-6 million copies of their album were downloaded illegally through Napster, Kazaa and Morpheus. Were it not for illegal downloading, 3 Doors Down would be far and away the biggest band at that time. U2 big. They would have been headlining arenas and sheds at that point, instead of just now. Thanks to theft, 3 Doors Down stayed in the clubs for another few years. They also barely broke even and didn't make hardly any money on the strength of a record that was getting massive airplay, and virtually everyone owned. They basically had their Appettite, Joshua Tree or Purple Rain, but unlike GNR, U2 or Prince, didn't get the money, fame or recognition they deserved. To this day, 3 Doors Down is really nowhere near as successfull as they deserve to be. Because of theft.
One other thing. Notice how none of the younger bands that we like have any success. Notice how Lamb of God and Mastadon, for example, are still playing clubs? With a shitload more radio play than Maiden and Dio got back in my day? In 1986 there was no satellite radio playing metal. The hardest music that played was Led Zeppelin. Hell, AC DC didn't get very much airplay. Black Sabbath nothing (at least in D.C.). Metallica? By all rights, with the increased exposure, better availability of the music through itunes, Amazon.com or Best Buy (which didn't exist in the 80's and Circuit City didn't sell music), Lamb of God should be rolling in it, and selling out arenas nationwide. But because you idiots steal, that will never happen. yes, I hope that asshole rots in jail.

I heard a few of those songs, and I will not be purchasing Chinese Democracy.. The album sounds like an old band trying to make a comeback; nothing special about that.
If anything forgotten memories are going to contribute to the negative sales of this album, more than anything else.

Dude, I'm sorry, but I think your reasoning is flawed. 3 Doors Down still play clubs because there's not really anything special about them. They're in that same lump with bands like Nickelback, Fuel, and Staind. They play generic radio rock that most people would rather just catch the song on the radio and sing along than to actually go pay money to see. I think they're just as successful as they should be.
And Lamb Of God and Mastodon (two Os, not two As.) attract the audiences they attract. The venues they play are proportionate to their public exposure and the quality of the albums they release. Modern MTV and VH1 and all that barely play music anymore. And most major radio stations are told what's OK to play by their corporate owners. It's not DJ determined. So, great bands like Mastodon aren't getting the exposure they would have had they existed in the days before reality TV and corporate radio.
I live in Philadelphia and I've watched Mastodon go from playing in a church basement to the club that holds about 900 people to the Electric Factory, which holds about 4000, I think. It should also be noted that Philadelphia has rabid fans when it comes to everything, and certain bands that play bars elsewhere (see GWAR) play the Electric Factory here.
I'm just tired of the argument that free downloading is killing the music industry. It's not. A lack of creativity and good new bands and good material from the old guard is what's killing the music industry. Free downloading gives people the chance to hear something, especially when MTV and the radio aren't playing it. People who buy music are going to buy music. People who don't, aren't.

Slash has nothing to do with CD anyway, so why does he care if it is leaked or not? I'm sure he has made plenty of $$$$ off of GNR and still does and always will. If he is not a part of GNR why is he worried about their reputation? Their reputation is pretty low anyway, because of Axl's BS and taking 14+ years to complete a new album of original material. The new album will probably be shitty as with most new releases from older bands nowadays. But of course CD will probably do well on the Billboard charts even though the people buying it know it will suck, just because it is GNR. I think skwerl could have a decent argument in court too. 1. He only had the music available for streaming and 2. He was not using the tracks for profit. It's sad-all of these bands are so "happy" to see the fans at their concerts, but god forbid you don't buy their albums they hate your guts. It's not about the music or the fans, it's about the $.

What an overreaction from SLASH who is normally a carefree, laid back guy. If the songs are leaked now instead of in a little while in a "legal" fashion, how will that hurt the sales of the album? People are going to download now instead of a few months from now so what is the difference? How will this effect sales? People who download are going to do it anyway, it doesn't matter if it is now or before or during the release of the album. The same people will be downloading either way. Slash is overreacting here.

and the guy shouldnt be fined or get jail time, cause ... new bands get promotion from downloading and older and big bands get enough money from the touring and the cds sold to people who really like the band sooooo ...
if it werent for the illegal downloading most bands these days wouldnt be known and would play to 5 friends each night if all that ...

Axl will never give in & reunite though, he's painfully stubborn it seems. On a serious note...THIS exact situation has played heavily into why the album hasn't been delivered yet. There's a lot of $ sunk into this from a record company perspective and leaks directly impact their ability to recoup. It changes the landscape, impacts the deal, distribution...everything.
Strange the 'leaks' of Death Magnetic have been so well controlled. Makes me think that Axl has a curveball up his sleeve, but it's obviously real material if FBI and Interscope are involved.
Just release the damn album, and all this goes away. Thanks for listening.

Elton John and Billy Joel aren't saying anything because they're already RICH. They are far from starving artists who are the real victims of illegal filesharing. Either of them can earn between $500,000 and $1,000,000 for one show. And the Trent Reznor argument is ridiculous as well. The reason he's as big as he is and able to release an album via the internet is BECAUSE HE'S BEEN ON A LABEL FOR THE PAST 20 YEARS. I think if he walked into any radio station with "Head Like a Hole" in 1990 His contract expired at the perfect time - when he's a megastar. A great position for him not to be on a label but a horrible position for a new band.
The bottom line is good bands aren't getting signed because labels no longer have the budget to take a risk like they used to. Therefore the quality of music that you hear is declining. They can only afford to sign bands that they 'know' (and I'm not defending recent A&R signings by the majors here) are going to sell. Therefore all the music that you hear is regurgitated crap. I WILL agree with you on that. As well as the ludicrous 'War on Drugs' but that's a completely different issue.
The bottom line is now bands have less time to actually spend 'making music' and more time to worry about promoting etc...... things that record companies should do for them.

Libertad was leaked almost a full three weeks before the actual release date. That when I downloaded it anyway.
PS: I did buy the album the week it was released by the way. It's sad because the only actual CD's I DO buy are anything from Mike Patton, Axl, or Slash. Between that I may pick up a classic album if the price is right. I download almost every other band.

All the albums Slash have played on since GNR are very good, both solo and Velvet Revolver! and yea this guy should go to jail just like any other people should to for theft. doesnt matter if its a famous band or underground metal band or whatever music. then people who steal cars and banks should just be allowed to steal too??? and who gives a shit if Slash wears a tophat, he have been wearing it for long time and if he likes then wear it! just like anyone else should just dress in whatever they like. yea and anything Slash and Axl Rose have done in the last 20 years is many times better than anything Metallica has done in 20 years hahah but everyone knew that. and for me personally everything by slash or GNR is many times better than anything by Metallica.

g n r may suck, the album should have been out ages ago, and all that shit, but in the end what this guy was wrong and what a moron for not thinking that he may get in trouble. Be it what ever band, this sort of thing really hamper the sales which is already down and I probably half the people here have never actually bought an album. The few of you who actually think this person should go to jail for copyright infringement are out of your damn minds. Why should the tax payers be burdened with this? Haven't they already payed enough with the FBI getting involved? It costs quite a bit of money to keep someone locked up in our already overcrowded prison system.
Enforcing copyright infringement shouldn't be the burden of the public. Enforcement of our draconian copyright laws should be funded by the media cartels. The only burden the tax payer should have, is the cost of supplying a court of law to determine if said infringer is guilty or not. The only punishment deserved is a fine. Not jail time, or community service.
