JOE SATRIANI Accuses COLDPLAY Of Plagiarism; Audio Comparison Available
- Dec. 5, 2008
|
|
Reuters reports that legendary rock guitarist Joe Satriani has sued COLDPLAY, accusing the Grammy-nominated stars of plagiarizing one of his songs. Satriani's copyright infringement suit, filed on Thursday in Los Angeles federal court, claims the COLDPLAY song "Viva La Vida" incorporates "substantial original portions" of his 2004 instrumental "If I Could Fly". The 52-year-old guitar virtuoso is seeking a jury trial, damages and "any and all profits" attributable to the alleged copyright infringement. Read the entire report from Reuters. COLDPLAY's "Viva La Vida" vs. JOE SATRIANI's "If I Could Fly":

Yeah I have no idea how far this will get in the courts, I remember a while ago a Rolling Stones song sounded very similar to a KD Lang song, they said it was all unintentional but they wound up giving her a writing credit anyway to avoid any problems. I think that occured before the album came out, so it's a bit of a different situation.

my favorite guitarist has borrowed 1 or 2 riff before...and even he said he barrowed it...but he turned it into a different song.
The riff's he actually write's himself toally own the 2 riff's be borrowed so who cares? if his best riffs were stolen then there would be a problem lol.

This could be a coincidence ,these things happen all the time ,there's so many artists out there it would be even more strange if these things didn't happen . basically Joe is suing them over 5 or 6 notes in a cord progression and a pretty generic chord progression at that. Im pretty sure Ive heard this chord progression else where on more than one occasion . Whats next ? people being sued for using the pentatonic scale? or the 'E' minor diminished scale ? If it sounds like a tune at all then it means it belongs in a scale , you cant copy right scales or no one would be allowed to write anything.

Coincidence. I find it highly unlikely that coldplay was sitting around listening to Joe Satriani and said "oh man, this song is awesome! Let's steal it!"
All songs sound like other songs - the concept of heavy metal revolves around this!

You cannot protect a chord progression. You can protect a melody. These songs have the same progression but so what? So does every blues standard ever written. The melodies in these songs are similar but only the first two notes are exactly alike. The rest of the melody is different. I don't think this one will hold up in court even though I'd like to see Joe pull in some cash from a shit band.

It is clearly the same song. The overlapping youtube video proves this. I almost stole a Coroner riff by accident once. As soon as I realized I changed it, but it was something I had been listening to recently and it was in my head. That may be how this Coldplay song started, but I refuse to believe no one in thier big budget, major label corporation picked up on that shit.

is it possible they blatantly stole the idea? Yes.
But I have come up with riffs before and thought they sounded especially killer, only to listen to a CD and find out that I somehow subconsciously repeated a riff that got stuck in my head from another song. One especially awesome riff I made, I found out was note for note the intro to the last song on Manticora's Black Circus Pt 1 album before I'd even heard it. So did they rip me off? NO.
Everything has already been done before by someone else somewhere. There is no uncharted map of notes left to be discovered.

I was referring to that Last Resort song. If you listen to their main riff and the part following the intro to Hallowed Be Thy Name they sound strikingly similar. But yeah, this kind of thing happens quite a bit. I don't know how many times I've heard riffs rehashed and reused. I remember hearing some Everclear song on the radio and it had the exact riff of an Elvis Costello song. Especially in metal this happens a lot as well. I really don't think it's always intentional. A lot of times, it's probably a subconscious thing. I remember listening to my friend's band years ago and recognized Megadeth's Hangar 18 riff in one of their original songs. They hadn't even realized it until it was pointed out.

Vanilla Ice's rip off of Queen was a subtle rip off. While they didn't sample it so they didn't have to pay Queen, they changed one note or beat. It wasn't a melody rip off, it was highway robbery. I think Vanilla won in court too? I forget.

The melodies between Joe Satriani and Coldplay are similar for about 5 seconds. They're not the same song and Satriani knows it - he's a has been who's looking to reclaim his moment in the spotlight. I've never heard Satch's song, and I'm sure neither has Coldplay (or anyone else, for that matter).
Love 'em or hate 'em, Coldplay is one of the most popular bands in the world at the moment, and everybody (including all the people on this list) are going to take their shots at the them.

If you're writing riffs like the riff master Tommy Baron from Coroner, then you must be the guy that I've been lookintg to play with for some time! Nothing wrong with writing riffs on that level of guitar mastery! What an underrated band and guitarist. Holy shit were they awesome!
Anyway, I hear the same chord progression in every damn pop punk song out there. I hear that progression from Green Day, Blink 182 and before from Pat Benatar, Boston (More than a Feeling), "Smells Like Teen Spirit. I'm sure if I could chant it out, people would know right away. Y'know 2 strums on each chord and there are 4 chords in total. The first two start higher and then the riff descends a little lower afterwards. This riff is constantly used in one way or another with ever so slight variations. Since pop punk bands use it every damn time, I have learned to dislike it.
Musical plagiarism is always done. A dime a dozen songs and riffs are ripped off constantly. Damn shame. Can't stand that shit!

Its been like this for years! People steal, borrow, use whatever riff or melody they want and alter it in such a minute way that it will never hold up in court. Think back to the 50's and all the WHITE "r&b" artists stealing all the real mo-town songs note for note, and nothing could be done about it. What about your boy Yngwie? He rips off Paganini, Vivaldi, Bach, Mozart all the damn time, but there is a difference, Its called public domain. Songs that don't renew their copyright after a certain amount of time end up as public domain. Now, really lame ass musicians will blatantly rip off these extraordinary composers (al Yngwie) and others will take and alter or expand apon (ala Jason Becker, Satch etc). I hope Satch wins this case, although he probably won't because there is just enough difference in the melody (maybe 3 or 4 rhythmic notes at most) they will either settle or dismiss. COPYRIGHT YOUR SHIT PEOPLE!

Yes they do sound alike, but I wouldn't be surprised if no one in Coldplay has ever heard any Satch song at all, much less that song.
That is hardly an original melody to begin with. I think there were a few pop songs in the 80's that had vocal lines that sounded like that.

I'm a guitarist myself but rarely ever listen to instrumentalists like him or Vai, or even Yngwie for that matter even though he's not strictly instrumental. I would really doubt that Coldplay guys are fans of Satriani. He's not that known outside the guitar community overseas and Coldplay are not really a guitar band.
Earlier this year people were comparing BFMV "Scream, Aim, Fire" to some cheesy ass Primal Fear song. That was at least plausible since those two bands have actually played the same festivals. PF was cool about it and praised BFMV.
There are billions and billions of songs out there, some riffs are bound to be similar. Joe should be flattered...

Also.... per Wiki...
Coldplay were briefly accused of copying portions of "The Songs I Didn't Write" by American alternative band Creaky Boards, for the melody of "Viva la Vida".[15] Creaky Boards' band member Andrew Hoepfner claimed that Martin had heard them playing the song at a live show in October 2007.[16] The band released a video clip, in which it compares sections of both songs.[16] Coldplay denied the claim; band spokesman Murray Chambers said Martin was working in AIR Studios in London at that time, having checked the singer's diary.[17] In addition, Coldplay had recorded a demo version of "Viva la Vida" in March 2007, long before Creaky Boards performed it live in October of the same year.[16] Creaky Boards later retracted the accusations and now speculate that both songs may have been inspired by the video game The Legend of Zelda.[17]

Often times guitarists seem to write riffs similar to other riffs. Not intentionally, but because they hear it in their head and don't recognize it to be somebody elses, then they work it out and change it to make it their own. I mean, is it similar? Yes. But it's not the exact same. I know I've written guitar riffs before and then I've gotten an album and listened to it and gone "damn, that really sounds like X riff!" Coincidence more than anything.

I don't eat steak for dinner every day. And I don't listen to metal all the time either. Honestly, many of you are like my six year old that could watch the same episode of Spongebob every day and be perfectly happy. Open your ears to more than just metal. You will find that those musicians listen to a lot of different shit, and it comes off in the music. For starters, I'm going to list a few artists that basically layed t

Now everyone who hasnt heard both songs will buy them, because no one here downloads illegal music right? Hoever based on what I've read in these comments, It seems both Papa Roach and Cold play steal and obviously not very well since it also seems both bands suck. And Yes Metallica stole---most notably Seek and Destroy and Sanitarium (I have the original by another band) Also Slayer stole from Iron Angel or vice versa but I cant remember which song for either. But I realized it driving down the road one evening on my Ipod, just sheer luck since it was on Shuffle.

This also reminds me of that Youtube shit, bands that sound the same video. the Fretboard has approx 22 frets and usually six strings, its impossible fro two bands playing the same style not to cross paths at some point.

there's influence, & there is completely ripping off. If your guitar sound is just like say Brian Mays, and you write a song that sounds like Queen production, yet the song is not like any queen song, then you might want to find a more original SOUND, but you are not plagirising. But, if you take a whole riff, or the melody is spot on, then you've stolen. That Vanilla Ice is a great example of completely stealing, that's not even subtle....of course too, if its a more standard blues rock beat, then its sort of up for grabs, say a song like "ice cream man", never heard the original, but there are thousands of the same song, different lyrics.....I just saw a coverband do "what I like about you" (go figure) & in the middle of it cut into "R.o.c.k in the USA" & its identical. But that's a pretty standard 50's style rock beat...Now one of my favorite bands, I've come to find out not only stole from the blue artist(like all the 60's English bands), but Zep took whole songs. The intro to Stairway is completely ripped off from a spirit song. Shamelessly, & Im a huge Page fan, but I was shocked. They toured with Spirit in 69-70 & Page heard it...there were countless others.

There's only 12 notes in our Western scale. There's only so many combinations.
Did they lift it? Probably.
Does it matter? If big bucks are involved, sure. Lawyers gotta get paid somehow, right? Fuckers...
But EVERYONE STEALS, even if unintentionally. There are probably no original combinations left.
Balls.

I hope Satch wins !
Btw, some greek pop singer, has stolen Coldplays Clocks, and when a journalist asked he about that, he lost his job .... nice ha ? here's a vid of that .... http://www.youtube.com/watch?v=O3xx9e1XfJI

12 notes yes, unintentional, subliminal type stealing, it happens. Say like the Black Crowes, I guess they listen to a song then basically tweak it enough that its different enough. They are very derivative. But stealing say a whole intro, or exact melody? hoping maybe the person they steal from is obscure enough no one will know. Off with their heads!

Yes they do sound alike, but I wouldn't be surprised if no one in Coldplay has ever heard any Satch song at all, much less that song."
My thoughts exactly. The guys in Coldplay just don't seem the type to listen to guitar player records. They like stuff such as Kate Bush and english 80s pop groups.

Any rock fan remember Kingdom Come? They were widely accused of ripping off Led Zeppelin - same style, same type of riff, same singing style - did Zep sue them?
As for Satch (not Satchmo - whichever F***tard wrote that clearly doesn't know anything about music) - he is one of the most original artists of modern times.
Joe Satriani has been in the business for many years and has written some mindblowing tunes/songs.
Case study 1: Joe Satriani taught Steve Vai the guitar Case study 2: Joe Satriani coached Kirk Hammett from Metallica in the year or so before the black album
So, anyone care to suggest that Vai and Hammett have originality - sure you can argue how Vai is a highly gifted guitarist, but both he and Hammett's styles have elements of Satriani. Should he sue them?
No.
However, Coldplays "Viva La Diva" os too similar to Satriani's tune, so much so that I agree with him protecting his music. It doesn't take much for an artist "borrowing" any part of another artists creation, if they only give credit for it.
They have shot themsleves in the foot here, but as others have suggested on here - it could very well come down to coincidence.
We shall wait and see.
BTW - I am a fan of both Satriani and Coldplay - both songs are class!!!

Zep would have Sued Kingdom come if they wrote a song that had the same exact riff or melody as one of theirs. Sounding like a band, notting you can do, but writing the same song is another matter.

Actually, I am siding with Coldplay on this one. I doubt they've been able to remove the cocks from their ears long enough to listen to a Satriani album. Coldplay is inspired by man-goo, not instrumental music.

Wasn't there a small indie band too that was similar to "Viva La Vida"? Anyways, I thought that the new Coldplay album was ok. Not as good as their previous stuff, but still classy when compared to the crap that is popular right now.
P.S. I actually like the mash up in the end of the video. I think the song would sound better like that.

Use Santriani's guitar and put it on a french artist Alizee song's J'en ai marre (played a bit faster) and you have Vida la Vida exactly, just add Chris Martin lyrics. It's the two songs in one untouched, notes for notes. Hope the french artist sues also! And Coldplay can go to hell! And pay out! Of course.

Even though the guitar has 6 strings and 24 frets or whatever, there are many, many different modes and scales and patterns and even if you don't know them, there will always be room on that instrument to create something unique - I hope! That is a scary thought considering I've been playing for 25 Yrs and love the sounds of a guitar, acoustic or electric more than any instrument.
Sometimes, however, people are innocent. I've known vocalists for example, or a vocalist let's say, who sounded like Keith from LOA but had been singing way before LOA came out or Keith Caputo from LOA was even heard of! Total coincident! What do you do if the vocalist you sound like is in a more popular band that you actually never even heard?!?! Do you then have to change your whole tonality to escape all of the rip off insults you'd have to endure?! My friend was lucky that LOA isn't that big but it could of been a bigger band. Keith is indeed a great, talented individual.
I miss that back in the days of classic rock, popular bands were also talented, unique, and wrote with substance. They had their own identity mixed with talent - and they were appreciated and became big for that!! What ever happened?!?! I think MTV and sheep mentality amongst the kids of today is what happened. All these popular bands are popular from the main consumers out there: female pre teens and teens!!
The question is, what is the fine line between being influenced and blatantly copying?!? To be influenced is fine as far as the law goes, it's just when the notes or melodies etc. coincide so tightly, that it is very apparent that there is some serious stealing going on!
BTW, I cannot see Coldplay listening to Satch; HOWEVER, that is how a band like Coldplay knows not to get caught because they can use their total difference in style and Satch's unforunate and undeserved relative obscurity as their excuse to not ripping him off. Could just be a clever attempt. Who knows?
BTW, I have met Satriani several times over the Yrs back in Long Island where he is from and where I lived for 18 Yrs - he was nothing but a complete gentleman. He NEVER had a rep for being a prick. Not this guy! Maybe Axl or Motley Crue but not Satch! Never.

Oh yeah, it's amazing how one segment of a Satch song will never get recognized by the mainstream but when Coldplay makes a fucking entire song out of that part of a Satch tune, it sells millions! Goes to show how fucked up this music industry is and why a lot of talentless, yet famous, big bands, due to their undeserved exposure, can simply take a segment of a song, make it a whole song and sell millions! What about the people that actually write the shit that no one even knows?? What a corrupt, asskissing, phony industry, not unlike politics and the disgusting, corruption provided by the legal system!

If you went out and bought Master of Puppets, you would read the booklet and realise that they were paying tribute to Rush.
And if this were the case, then Graves-era Misfits would be up shit creek, because two of their songs at least have blatant rip-offs from Metallica songs. The up tempo second part to Helena sounds note-for-note the up tempo section to Sanitarium. And the intro to Scarecrow Man is the same guitar effect direct from King Nothing. There are probably more that I could find but I'm not really bothering to listen

Check out Green day's brainstew, Beatles While my Guitar Gently weeps, Chicago's 25 or 6 to 4 and Led Zeppelin's, I forgot which song but all of them have the same progression and timing. There is also Steve Millers the Stake and Joe Walsh Rocky Mountain Way. It is easily possible that they just happened to right something similar, you only have twelve notes to work with, so many monkees with typewriters you know.

You fucktard...just because somebody lists a band in their 'thank' section of an album doesn't mean a part in one song that sounds like a part of another song means they are "paying tribute". It was an un-intentional swiping. Also, I bought the vinyl version of Puppets in 1986. When was it that you bought it?
And you misspelled 'realize'. Must be a limey.
