YouTube A Factor In JOE SATRIANI/COLDPLAY Legal Battle? - May 21, 2009
The Pulse of Radio reports: The copyright case brought against COLDPLAY by guitarist Joe Satriani, who claims the British group ripped off his 2004 song "If I Could Fly" for their 2008 hit "Viva La Vida", could take an interesting turn, according to MusicRadar.com. The site pointed to an article in the April issue of Entertainment Law & Finance, in which three lawyers in the Intellectual Property Group at a firm called Kilpatrick Stockton LLP note that the "surprisingly detailed" analyses of both songs posted by fans on YouTube, many of them side by side comparisons, could be admitted as evidence if the case goes to trial.

The attorneys wrote, "Within days of the suit's initiation, YouTube was inundated with postings in which fans freely offered their opinions concerning the merits of Satriani's claims (or absence thereof). Some of these submissions were supported by surprisingly detailed analyses of the works."

The article points out one in-depth analysis in particular that was posted by a Canadian guitar teacher (see below).

Other posts pointed out similarities between Satriani's tune and older works by other artists, which could bolster COLDPLAY's defense.

Satriani has taken a less angry tone in recent interviews about the case, telling The Pulse of Radio that it's working its way through the legal process. "You know, it's one of those things that is annoying to talk about, because I can't talk about it," he said. "But I can tell you that the legal system is going through its paces, the protocols are all being met, and it's making its way between various law offices and the courts, and it's just one of those things. I'm pretty confident that there will be an equitable solution reached at some point."

COLDPLAY has denied Satriani's accusations and has so far refused any kind of financial settlement with the guitarist.

Singer/songwriter Yusuf Islam, formerly known as Cat Stevens, has also accused COLDPLAY of plagiarism, saying they ripped off his song, "Foreigner Suite" in "Viva La Vida". Islam has not revealed whether he also intends to sue.

i find using youtube as a way of hear all those cool demos/ live boots that everyone posts ie. Black Sabbath/ Born Again demos, Beheler/ rehearsals, AIC/ Dirt demos, Exodus/ Whipping Queen demos, Beyond Possession...Is Beyond Possession out of print tracks. Gotta love it!

Singer Lord Coldplay had no idea his guitarist Jizzy Coldplay stole the songs melody from Satch, that he presented to the band. "I just came up with this riff in my head on the hopper, its so us".

As much as I'd like to side with the guitar god on this, it should be pointed out that Coldplay was already this huge band. While that doesn't rule out the possibility that they used his riff, it does rule out a lsituation where someone was trying to cash in on another's success.

If I work my ass of writing a killer song(which does NOT come easy for me) and I find out later that it sounds similar to something else, there's no way I'm gonna feel bad about it. It would be quite different than if some band wrote ten songs in a week that had all their favorite riffs all over them.

This is a principle that should be taken into consideration.

No, it's shouldn't be taken into consideration. There's a reason why a lot of people don't listen to a lot of music while writing their own stuff, to avoid being influenced.

it would be easy for the opposition to dispute this as formal evidence in the case, these types of cases are about the worst kind for any lawyer..

did this guy go to chord forensics collage? it almost sounds like he's doing an autopsy on the song. This is to far, There is a lot of music that sounds like something else and its not necessarily stolen. As for the geek with the strat, shut the fuck up!

There are only so many riffs, and so many variations/combinations of them. Coincidences like this clearly is are bound to happen from time to time.

Would a major band like Coldplay WILLINGLY blatantly steal an already famous riff from another major artist and then just hope to get away with it thinking that noone in the entire world would notice!?

I smell bullshit on this one.

I give so much less than a CRAP about either Joe S or Coldplay that an electron microscope would struggle to differentiate but that balding, bespectacled guitar tutor is THE MAN. I watched both his videoes and was agog. The perfect intersection geekism and genuine critcal enquiry. Franly I am a fan. If you are reading this guitar tutor person send me an e-mail and I will regard my sojourn on this miserable planet complete.

influence is when you get inspiration, maybe write in the same vein, capture a simular sound, not lift a whole melody line. And the argument "there are just so many notes", is true in some cases, but again, this is a whole melody line, many notes and phrased the same, same tempo.

As far as Coldplay not being into Joe, they do seem like different worlds, but maybe the guitarist is into guitar music, learned this song, or listened, & took it, presented it....or Carl Coldplay & Gweneth Paltrow sit around & play baby Apple Joe Satch so she can drift off to sleep. ...off with ColdPlay's heads!

i'm against this lawsuit crap- there are only 12 notes, and whatever number of chord progressions that should go in a meter, which is limited. if this is allowed, every songwriter in existence would be able to get sued...
everything's about context anyway, and the songs obviously have a different feel and are for different audiences.

The Coldplay track is a blatant rip off because its the main riff through both songs.....there are tons of examples of this stuff throughout musical history, most of Zeps stuff is plagarized in some fashion......the LOG lifted Testament riff, the similarities of the new Kreator CD which has some vaguely suspect Metallica riffs from ealier material.

Some bands have made careers off ripping off other peoples music....Vanilla Ice anybody? MCHammer? Puffy Combs?

Selling tons of records does not make it right to steal from others....at least Puffy PAID for his thefts up front. I'm sure if Coldplay had went to Satch and asked for (and paid for) the melody....something could have been worked out before hand. But NO....."we're so popular we don't have to ask" is what they seem to think. It is a BLATENT rip off, and for ANY serious guitar player to say they don't listen to Satriani....is a bald faced lie. Satriani, Van Halen, Page...are considered GODS in the guitar world.
Satch is a VERY well respected, and talented musician who taught some of the best guitarists around (Vai, Hammet), and is spoken of very highly by anybody who has ever had dealings with him.....a true ARTIST, who never sold out. Coldplay from what I've read, are pretty much douche-bags, and the 2000's equivalent of "Duran Duran". Which do I believe? Duh!
