OZZY OSBOURNE: 'The BLACK SABBATH Trademark Should Be Owned By The Four Of Us Equally'

Ozzy Osbourne has filed a lawsuit against his BLACK SABBATH bandmate Tony Iommi, claiming that Iommi illegally took sole ownership of the band's name in a filing with the U.S. Patent and Trademark Office. Osbourne is suing Iommi for a 50 percent interest in the "Black Sabbath" trademark, along with a portion of Iommi's profits from use of the name. The Manhattan federal court suit also charges that Osbourne's "signature lead vocals" are largely responsible for the band's "extraordinary success," noting that its popularity plummeted during his absence from 1980 through 1996. In a statement released this afternoon (Friday, May 29), Ozzy says about his decision to sue Iommi, "It is with great regret that I had to resort to legal action against my long-term partner Tony Iommi, but after three years of trying to resolve this issue amicably, I feel I have no other recourse. "As of the mid-1990s, after constant and numerous changes in band members, the brand of ' BLACK SABBATH' was literally in the toilet and Tony Iommi (touring under the name BLACK SABBATH) was reduced to performing in clubs. Since 1997, when Geezer [ Butler, bass], Bill [ Ward, drums] and myself rejoined the band, BLACK SABBATH has returned to its former glory as we headlined sold-out arenas and amphitheatres playing to upwards of 50,000 people at each show around the world. We worked collectively to restore credibility and bring dignity back to the name ' BLACK SABBATH,' which led to the band being inducted into the U.K. and U.S. Rock And Roll Hall of Fames in 2005 and 2006, respectively. "Throughout the last 12 years, it was my management representatives who oversaw the marketing and quality control of the ' BLACK SABBATH' brand through Ozzfest, touring, merchandising and album reissues. The name ' BLACK SABBATH' now has a worldwide prestige and merchandising value that it would not have had by continuing on the road it was on prior to the 1997 reunion tour. " Tony, I am so sorry it's had to get to this point by me having to take this action against you. I don't have the right to speak for Geezer and Bill, but I feel that morally and ethically the trademark should be owned by the four of us equally. I hope that by me taking this first step that it will ultimately end up that way. We've all worked too hard and long in our careers to allow you to sell merchandise that features all our faces, old BLACK SABBATH album covers and band logos, and then you tell us that you own the copyright. "We're all in our 60s now. The BLACK SABBATH legacy should live on long after we have all gone. "Please do the right thing." Osbourne added in a separate online post, "I am very saddened that I've had to take legal action against Tony. This is something that I've tried to avoid for years. I am not Geezer or Bill's voice. However, 'till the day I die I will not change my mind on this issue. The BLACK SABBATH trademark should be equally owned by Geezer, Bill, Tony and I as the true BLACK SABBATH lineup is Tony, Geezer, Bill and I. We've all been mates since school. I've always said there is an invisible thread that holds us together. " Tony, let's get this ridiculous issue sorted and move on with our lives. You're 61, I'm 60. I hope that we've got a good 20 years left in us. But if not, God forbid something happens to you. What's going to happen to the BLACK SABBATH trademark? Who's going to oversee it? Don't you think after we're long gone the rights should stay in your family, my family, Bill's family and Geezer's family?" Ozzy's suit follows one filed by Iommi in December 2008 against Live Nation. In that filing, Iommi claims the concert giant sold merchandise bearing the band's logo, despite the 2006 expiration of a merchandising deal, reportedly worth nearly $80 million. Soon after that agreement concluded, Iommi reclaimed the band's trademark. Iommi's suit argues Live Nation continued to sell more than 100 items of merchandise featuring the band's likeness, name and logo, despite the receipt of cease-and-desist orders from the guitarist's camp. Iommi's suit seeks damages in the amount of three times the profits from the merchandise sales, plus a halt to the BLACK SABBATH product sales. Iommi and Geezer Butler have both said some less than kind things about working with Osbourne in a new interview with Decibel magazine. The pair recently completed a new studio album as HEAVEN & HELL, the post- Ozzy version of SABBATH featuring vocalist Ronnie James Dio, and Butler said that working with Dio was much easier than Osbourne. He explained, " Ronnie's a songwriter in his own right — he's got tons of ideas. Whereas Ozzy . . . in the old days, he'd come up with a vocal line and I'd write the lyrics. Ronnie is 100 percent involved in both the musical side and the vocal side, and he writes his own lyrics as well." Butler added that Osbourne didn't take him seriously as a songwriter, saying, "If we were with Ozzy and I came in with the killer riff of all time, Ozzy wouldn't even think of doing it because I'm not the guitarist and that's the way he thinks . . . That's why it was so bloody hard to write anything." Butler said about HEAVEN & HELL's debut CD, "The Devil You Know", "If we'd written this album with Ozzy, we'd still be working on the first track." Iommi added that there was a sharp difference between the singers live as well, saying, "It was great being with Ozzy on the road . . . but with Ronnie it's a lot different, because we go out and we know exactly what we're gonna be doing. With Ozzy, we didn't really know. It was touch and go sometimes on some of those early shows, whether he was gonna turn up, if he'd be able to sing, if his voice was gone, or what. We'd have to cancel shows, which Geezer and myself really hated. But with Ronnie, we've never canceled a show." HEAVEN & HELL will tour Europe later this spring and summer, with North American dates scheduled for August. Ozzy Osbourne is currently working on his next solo album. The only thing Ozzfest did was charge way too much fucking money for what it was. $120 to see Black Sabbath from a seat? Holy piss. I saw Heaven and Hell with two other bands (Alice Cooper and Queenryche) for $55!

All 4 men should own the name equally. They were the 4 inducted in the Hall of Fame, and they should all share it. Period. It's the only way to be fair to all.
Good point about Tony dying. If he dies, then the Black Sabbath name is forever gone from Ozzy, Geezer, & Bill.

Ozzy snowballed much bigger than what Sabbath became. Ozzy should have rights to the material that he performed on, but should have no say on the material after he was gone from the band. I have never researched the history, if there is such info, as to the ramifications of Ozzy leaving/being fired. Bringing this up so "late in the game" is ridiculous too. It should be simple, Ozzy gets royalties from his era, Dio from his and the same for GZR and Bill and anyone else involved.

Ozzy, Ozzy, Ozzy. You blew it. There are so many things wrong with this claim. Have you not already bled the Sabbath legacy dry on your own? Made the reunion secondary to your solo "efforts"? You've surely made enough $$ off Black Sabbath, why get greedy now? I'm sure it's not The good ol' Ozzman so much as it is his cow of a wife. But still, Ozzy, you used to be a man. Now you're a sad, sad little puppet. Your own legacy has been tarnish far more greatly than anything Tony ever put the Sabbath name through. I'm sure he always wanted great things for the band. Some of us fans never stopped supporting Black Sabbath. Believe it or not, but there were more than a few who felt Tony Martin was a better vocalist than Ozzy. Certainly Dio has a following which now more than ever rivals his Ozzness. Me, I will state on record that I feel Glenn Hughes has the best set of pipes of them all. To give a more complete picture of what I'm saying, "Born Again" was the current release when I became a Black Sabbath fan. Dio had just started his own thing and Ozzy was Barking At The Moon. I heard "Live Evil" and "Speak Of The Devil" before I ever got to investigate the original back catalog. The point of this is that Ozzy had already milked Black Sabbath heavily by putting out a double LP of live Sabbath songs. (They weren't bad either, Brad Gillis did some killer playing on that one.) Ozzy has stuck his hands into the Black Sabbath cookie jar numerous times over the years seemingly when he needs some financial security. The party is over Ozzy. Maybe you should be kissing up a little more to Zakk Wylde because after you lose this joke of a lawsuit he'll be all you have left. Well I guess you could look into rehashing something with Randy Rhoads on it. There should be some rarities out there. The "Mr. Crowley Live" picture disc is long out of print. And there was that live version of I Don't Know from the "Crazy Train" 7". I believe this time you won't be pleased with the outcome, Sharon. Everyone is seeing you for who you truly are this time around.

Ozzy's right, and why is it ok for Iommi to take the Sabbath name and use for himself? but Axl Rose is an asshole using the GNR name??? i aggree Sabbath was underrated in the late 80's and 90's but that happens to every band, they suddenly get older and some new(better or worse) younger band takes over the popularity. but of course all four of them should share the ownership. if it hadnt been for all four of them then no Sabbath even though Iommi did most. maybe he should get 30% or whatever.

Black Sabbath is and always will be Tony Iommi. So what if they were playing small clubs. If this is so important to you, where we you back in say 1984 or 1993, or anytime after 1980. Ya know if this is truly so important to carrying on the legacy and taking care of everyone's families, how about you doing the same for Lee Kerslake and Bob Daisley? Don't they deserve some of the wealth for the 2 fantastic albums they played on, and basically did all the work for? But even so...as TJisaSecksiBeast said...what ABOUT Tony Martin?? He sang on multiple albums in a thankless role, following Ozzy and Dio, and performed totally admirably.
What about Ray Gillen, Ian Gillian, Dave Spitz, Vinnie Appice...etc., etc., etc....Sabbath have had well over 20 musicians rotating in and out over the years.
This is a fucking fraud. Ozzy and $auron are pissed off that Iommi and Butler are having such success with Dio. THAT'S what this is all about, end of story.
First Ozzy and $auron fucked with Maiden, and ended up killing Ozzfest in the process, while Maiden have never been bigger. Now they're fucking with Iommi/Butler/Dio, and I hope they lose this battle, too.
$auron has made a career out of fucking musicians over, and karma is a bitch.

...let's not fail to give Geezer Butler his due. Not only one of the greatest bassists in not only the heavy metal genre, but in all of rock'n'roll, but the TRUE lyrical genius behind Sabbath.
Iommi may have stuck with Sabbath through thick and thin, but Iommi/Butler CREATED heavy metal.

Ozzy you haven't recorded a good album in many years. Hell", you aren't even metal any more. I think that you are jealous of the fact that Heaven and Hell is better than what you can come up with. Your law suit against Black Sabbath is stupid bullshit. Iommi had done his best to keep Sabbath alive and yes, there were low points. However I have been able to listen to all those albums without you on them far more and better that all the post Bark At The Moon crap that you have done. Zack has been the only talent that you have in the past 20 years. He has been the only person that has kept your band sounding metal.
While you were stoned and drunk off you fat ass, Tony was putting out album after album. In almost 30 years as a solo artist you have only released 9 studio albums Sabbath have put out 10 in 15 years. Iommi has become a icon and you have become a joke on late light TV shows.
Ozzy, to took two classic albums that were hailed my you fans as great metal albums and re-recorded all the bass and drum parts because you did not want to share any of the Royalties from them. You pissed on those albums that made you who you once were.
Sabbath gave us Heaven and Hell and Mob Rules: two albums considered to be two of the best metal albums ever. After Blizzard of Oz and Diary of a Mad Man, you gave us pop metal. Heaven and Hell is a classic. The Ultimate Sin is crap.
I saw Sabbath with you Ozzy in 1976, 1977 and 1978. Each time you put on a bad show. The band was great but you weren't. You were drunk and stoned. You could not remembers your lyrics. I could not understand what you were singing.
I have seen Sabbath at least 20 time without you from Dio to tony Martin and Not once did I see a bad show. No lyrics were flubbed. No drunk was on stage sinning, and I could understand all the words.
Ozzy, you should be ashamed of yourself. You had better susses out of Sabbath and sold more albums than Sabbath. You made Millions and still you want more. "Go to Hell Ozzy!" Ozzy, you are done and we in the metal world have know this fact for a very long time. Just retire and fade away so that we don't have to listen to you bullshit any more.

why should Ozzy be jelous of Heaven and Hell? he sells more albums then they do. and of course Dio should get credit for the albums he made just as Tony Martin should for his stuff. but the original Black Sabbath was Geezer, Iommi, Ozzy and Ward. and so what Ozzy didnt write anything, the songs were written for his voice and most likely came up with some of the timings and how the songs should be and all that. everyone brings something to the table, but theres always 1 and/or 2 guys that do a little or much more then the others.

For the people who keep crying "why ask for 50% then say 25%" crowd, put 2 and 2 together. Ozzy does not want to take Iommi to court, the suit and the statement are a combined move to get Iommi to "voluntarily" propose a four-way split. This is Ozzy saying "I'll drop the suit if you propose this four-way split." Ozzy had to do something legally to be taken seriously, he can't just release a statement "Hey Tony, mind giving up 75% of the Sabbath trademark?" Obviously Butler isn't going to sue his own band member. The only legit suspicion is why Bill Ward's name isn't on the lawsuit.
I'm not a huge Ozz fan, not even a diehard Sabbath fan, but I think Ozzy's statement makes some decent points

Oh, I dunno...they SOUND GOOD. They have the respect of their metal peers, and they kick ass live, while anything Ozzy has put out in the past decade has been laughable.
I feel very fortunate to have seen the original Sabbath lineup on Ozzfest in 2004 and 2005, but Ozzy was the weak link, for sure. Playing the same 10 songs over and over, either because his vocal range is shot, or he can't remember the lyrics even with five teleprompters around the mic stand.
I will always respect Ozzy's singing in Sabbath...not the greatest technical voice, but his otherworldly quality sent Geezer's lyrics into the stratosphere.
HOWEVER...the fact remains that he was only a singer, and contributed less than the other three did to Sabbath's success.
Ozzy's solo career would have gone nowhere without $auron's shrewd business sense, but even that seems to have dulled in recent years. She's ran the well dry, and there's nothing less to exploit. Hence, this lawsuit.

He never wrote a thing for Sabbath, yet he got song writing credit for each song he sang on. Thats coming back to haunt them. No, Tony dosn't owe Ozzy any ownership rights, let alone half.
You think Slash will ever get any ownership rights of the GNR brand? And he actually wrote those songs.

I think if Ozzys latest TV show (reloaded) had done well we might not be seeing this lawsuit, he's just run out of things to milk. Ozzfest is done, no more TV shows, his solo albums haven't sold big in years. He could make money touring but he cant sing anymore so that's out...

I agree that Iommi, Butler, Ward and Ozzy should receive equal rights to the name....they are the founders of the band. And although Ozzy is probably the least talented musician in the bands history his voice is the most recognizable out of everyones....like it or not he is the voice of Sabbath. Dio, Tony Martin and Ian Gillan should receive royalties from the records they performed on not from the Black Sabbath name. Ozzy needs to change his suit aganst Iommi to 25% not 50%.
Sabbath started to lose popularity with their last 2 releases with Ozzy (which IMO are fantastic). When Heaven & Hell came out they regained it back. H&H and Mob Rules were very successful for them. Once the late 80's and 90's hit it started to look bleak. But to his credit Iommi stuck it out releasing great albums with Tony Martin. The true fans stuck around. Ozzy and his stupid wife are just bitter and can't accept that Sabbath has been great without him.

Iommi bought the legal rights to the name in the mid-80's after the whole Born Again thing fell apart. He's been the rightful, legal owner of the Sabbath name now for decades, so it's not like this was some kind of "surprise" that everyone just discovered. Ozzy is entitled to any songwriting/publishing royalties as a performer on Sabbath material, but that's it. This does really suck, as it most certainly destroys any opportunity for a final go-round with the original 4. Greed destroys everything good.
Does anyone remember the Ozzy press release that came out around the first Heaven & Hell tours? The one that promised a new Sabbath studio album, tour, etc with the original lineup? We all saw what happened with that...It reeks of a jealous old boyfriend trying to get the attention of his old flame - In 2 years, H&H has embarked on multiple world tours and released an amazing new studio album, and nobody really seems interested in what poor old Ozzy's up to now.
But the bottom line is Ozzy is a narcotic fueled, parkinson's driven old man who has no control over his own business practices. This is 100% Sharon Osbourne. Just when I thought that she couldn't do any more to destroy Ozzy's credibility, I'm proven wrong with news like this. BTW - How's that new variety show going Ozzy?

There will never be a Re-union of the Original line-up ever again. Stick a fork in 'em, they're done. There will never be a new studio album from the original line-up, which is fine because the Dio era is my fave. The Devil You Know shits on almost everything that's come out in the last year except the new Candlemass, which shit's on everything, period. Now I just can't wait until the new Sacrifice comes out.

Iommi is Sabbath. Sabbath was built on the strength of Iommi's riffs, not on Ozzy's voice. The superb Dio line-up proved it, and continues to prove it with H&H.

THE BATTLE FOR BLACK SABBATH continues. Read the book, "Sabbath Bloody Sabbath, The Battle For Black Sabbath" to see the proof for this. Pretty much every fucking time Sabbath gets up a little higher on the success notch than Ozzy, shit starts flying. Ozzy has had this problem with Sabbath since he left and Dio came in with HEaven and Hell and showed that Sabbath could not only continue without Ozzy, but that a lot of people preferred in that way (myself included), or at the least certainly showed that they were open to enjoying it.
And look at that Dio snub "The Manhattan federal court suit also charges that Osbourne's "signature lead vocals" are largely responsible for the band's "extraordinary success," noting that its popularity plummeted during his absence from 1980 through 1996." Yeah, only after the Heaven and Hell/Mob Rules success. And even Born Again was a kick ass crazy album. And Honestly, if you look at the figures, thing were picking up again by the time of Headless Cross and TYR. They were building it back up again. That's one reason Dio came back and tried again with Dehumanizer.
Yes Ozzy, we all know that you were the first singer and (along with the rest of the band) are largely responsible for the success in the early days, and if you look back at interviews and shit (all recorded in the above mentioned book) you will see that shit flies EVERY time there is big success with Dio singing for them (the Heaven and Hell era and now - the Dehumanizer time was plagued with internal problems for Sabbath and Ozzy was doing well so you see little bitching there). Well guess what? They aren't even going out as Sabbath, they changed the name to Heaven and Hell. But I guess that isn't enough.
IOMMI IS SABBATH. Even in the early days, Ozzy was often crazy and a mess. READ THE DAMN BOOKS OUT THERE. And every time Ozzy left, fell apart, whatever, IOMMI was the one there holding the pieces, right down to the SEVENTH STAR album (Which I kinda like actually). And guess what? Tony Martin was with Sabbath a hell of a long time and there is some good shit there. A lot of people have contributed to the Sabbath Legacy. And if it should all be split equally, then why ask for %50 ?
I've been a fan of Ozzy's since the 80's, and he just seems to get stupider as time goes by. I still love his music, but I wish he and Sharon would shut the hell up. Ozzy, you have proven two things over the years, 1, that you make some cool albums, 2 that you and your dumb ass wife are idiots that should shut the hell up outside of your albums. Thanks for pissing on the Sabbath name. Besides, if you got ahold of more rights, you might just rerecord parts of Sabbath albums you didn't like or thought people didn't deserve to be paid on like you did with your own shit. FUCK THAT!

The last page of the document Blabber posted says that Ozzy and Sharon own www.blacksabbath.com and get 50% of Sabbath merch sales (Iommi gets the other 50%). Looks like Iommi, rightfully, didn't want Ozzy making money off merch/web hits for an album he wasn't playing on.

Hate saying it, and I know I'm gonna get blasted for it, but I do recall when the dehumanizer came out, I don't recall hearing a whole lot of buzz on that, and that was an early 90's album, with Dio on it. Of course he left because of whatever you want to believe, some say it was the No More Tours tour last few concerts when Sabbath performed with Ozzy. But I do recall that Rob Halford ended up singing in Dio's place because if it. Point to the whole story here was I don't recall a whole lot of buzz around the dehumanizer album, ( in all fairness there wasn't no internet at the time either) However when the original sabbath reunited with Ozzy seemed as though they were every where again. Even though Ozzy quit, got fired, and quit again, or whatever, Dio also did the same. Dio did how albums under the name Sabbath three? I could be wrong, Ian Gillian did how many? 1? I think and the countless others who came and gone too. Ozzy has done the majority, as well as Geezer, and Bill. So yes I think it should be in all of there names. Dio and all the others maybe a little percentage, maybe. But to say that overall this isn't a fair request I think would be bull shit. My opinion of course.

Sharon doesn't even realize the level of hate most people have for her greedy ways, she makes me sick, the fact Ozzy makes more money than the past Sabbath singer is not a reason enough to give Ozzy the rights for a band Tony has carried 15 YEARS! when Ozzy was doing his thing and always throwing shit on everything Sabbath were doing. And are Sabbath with Ronnie playing just the clubs? Hell no, they've just had a top ten release, I would have loved to get another record with Ozzy but not if the price Tony has to pay is surrender the rights for his band, you can't count on Sharon, we've not had a studio record with Ozzy in 12 years since the last reunion. I love this myth going around that Heaven and Hell are more successful than Ozzy. Ozzy is rolling in dough and alone his band could sell far greater than H&H ever would, you think he's doing this for some more money? Dio was the one playing to clubs of 300 before H&H came back around, not Ozzy. This has absolutely nothing to do w/ money and everything to do with him claiming (rightfully so) that the name should be equally split amongst the 4 original members. The 50% is a starting point of negotiations to catch Iommi's attention, nothing more. Iommi's a god and my favorite guitarist of all time but if he doesn't agree to this split, I'm on Ozzy's side here considering how he (Iommi) already dragged Sabbath's name through the mud too many times.

Geezer also left in the late 80's to only to come back here and there. Tonys been the only sole member running that show. Im sure Ozzy has been his royalties for the albums he sang on. As far as the Dio thing, well, they're not out there as "Black Sabbath", they're "Heaven and Hell" which actually was a smart move of Iommi to call it that. As the Black Sabbath thing was but to rest after the Hall of Fame induction - end of an era so to speak. I could see if the current Heaven and Hell thing was called Black Sabbath, and they were singing Ozzy tunes, but theyre not. Its strictly Dio era stuff ( which rules by the way) Then Ozzy would have a case. I dont think this will go very far. Iommi seems pretty savvy and has played it smart all these years. This is nothing like GnR where one guy pushed the others out of the band and then went behind their backs and got the rights to the name. I think Ozzy and Sahron are jealous and smell $$ because of the massive success they've been having with Heaven and Hell over the last few years....we will see....

IF you want to argue money wise, of course not cause Ozzy as been doing solo albums since the 80's. That is a lot longer than all the Dio years with Sabbath of course. He should have full control and ownership of the Black Sabbath name. He was the only member of the band who played on all the albums and kept the name & band going for all those years. After all the loads of line up changes etc. So Tony should be the rightfull owner.

No one disputes the success of the original lineup. But to claim that Black Sabbath is limited to it, is just absurd. Both with Dio and Martin, Black Sabbath produced some of the best metal albums of all times. Who in his right mind can deny the grandeur of Heaven and Hell and TYR?
Besides, that's not even the point. The commercial success a band receives has nothing to do with trademark rights. Ozzy never challenged Iomi's right to call the band his own up until now, for obvious reasons. Greed is a lousy counselor.

Ozzy really wants Black Sabbath to mean ONLY OZZY SABBATH. I'm pretty sure what he would like to do is take all Dio era albums and rename then HEAVEN AND HELL. And then either delete from the catalog or rename any other albums with Tony Martin, Ian Gillan, etc., befuddle it to TONY IOMMIE's Sabbath or whatever. That's how the Ozzy empire works. Let's use another band for perspective:
Let's say Bruce Dickinson never came back to Maiden. And today he sued Steve Harris for 20% of all revenues involving Maiden merchandise. What about Paul D'ianno, using this same logic? What is he entitled to?
(I have no idea how Steve has his revenues and trademarks set up between him and his band mates, but play along)
How then would this look? It's pretty much the same thing, isn't it? From this perepective it doesn't look like Ozzy's case holds much water.

Because he's the only plaintiff in the lawsuit. Ozzy can't ask the court for relief (monetary damages or declaratory relief--partial ownership in the mark) for other people who are not party to the case.
He asked for 50% because Tony (the sole owner at the time the suit commenced) is claiming he owns 100%. If Geezer, Bill, etc. were also plaintiffs in the case, then the three of them probably would have requested four equal 25% shares, but Ozzy can't ask the court to give something to them because they didn't join the lawsuit--for obvious reasons.
Basically, Ozzy can ask for whatever he wants for himself (within some boundaries), but he can't ask for anything for someone who isn't part of the suit.
I'm not commenting on the merits of the suit, I'm just explaining why Ozzy('s lawyer) didn't ask that the rights to the mark be divided more than two ways.

when you think about it, Ozzy must be really damn insecure about Sabbath. He certainly doesn't seem to appreciate his own career enough. I mean, aside from the whole Lee Kerslake and Bob Daisley fiasco (the butchering and re-recording of Blizzard of Ozz, Diary of a madman, and the Bark at the Moon crappy remix), there are a number of Ozzy albums that are currently listed as having been DELETED from his catalog (will no longer be made) :

Even the fucking Ozzy and Randy Rhoads live album TRIBUTE has issues. Rudy Sarzo talks about this in his book, Off The Rails, about how Ozzy originally HATED the recording, made a big fucking stink about it. Now, just look in those liner notes how its a great tribute etc., anything to make a buck. (The recording is fine, its a good show).
And the list goes on. There is so much fake crap and bullshit going on behind the scenes with Ozzy, just read the books. But now, now he's spilled some of it out for the world to see. STUPID, STUPID thing to do Ozzy! I mean, to actually sue Iommi... Fucking shit. Dude!

Like I said, I wasn't commenting on the merits of the case. If Tony bought the rights from the guys, then this suit's probably a loser and was only brought for publicity or to try to push Tony into a settlement--neither of which would surprise me since Sharon is involved.
I don't know anything about the ownership of the Mark or the merits/facts of the case. I was just commenting on the procedural question of why Ozzy (the only plaintiff) didn't ask for relief for other people not party to the case.

I think its clear that he just wants to own everything that people deem great that he has been involved with, and wants to erase or delete anything that is thought of as poor in quality or has given him any trouble. He wants to re-write history. Show no blemishes. I think he's even said somewhere that he doesn't like to watch himself live. He certainly seems to avoid releasing any decent stuff, Rhoads era or otherwise. Some of this is due to their not being a whole lot from the early days, but the fact is a lot of it has to do with the people playing on these shows with him and he doesn't like to share profits. I know, I have a a decent bootleg Ozzy live dvd collection.
Ozzy and empire hates to share. He wants to be king. It might be some sort of drive that goes all the way back to the school days with him and Iommi, who knows. But the name Black Sabbath, the fans, and Iommi, deserve a lot more respect than this...

IF ANYONE HERE IS MISSING ANY BLACK SABBATH ALBUMS, Especially NON-OZZY era stuff, you might want to consider picking them up. (feel free to avoid "Forbidden -1995" unless your a completist like me). Recently, Seventh Star was re-released (as a fairly cheap import at Amazon) and that's pretty cool, its laid back stuff. Not typical Sabbath, but there's some nice stuff there.

Dio resurrected Sabbath from the void, and Ozzy after 2 brilliant Randy Rhoads albums, descending into pop farce - each year more embarassing than the last, while Sabbath was making great music with Dio and Tony Martin. Ozzy does have a point. That it should be owned by all of them, but he should only make money off of it if they sell something that he was involved in (as should all other musicians involved with BS). He shouldn't get paid for the sale of a Mob Rules T-shirt or Born Again cd. Iommi was on everything and he's been there through it all, so he should get paid for everything sold.
Maybe the Black Sabbath name should die with Iommi. At least people still respect it. If $haron gets a hold of the rights, she'll ruin Sabbath like she did Ozzy. Look at how she's made him a laughing stock. I hope this blood $ucking leech gets what's coming to her soon!
BTW - one reason for Ozzy's popularity was that he was more radio-friendly than Sabbath was. Though you made money and were popular doesn't necessarily mean you were better. Appealing to the masses isn't always a good thing (especially in the metal world).

This is Toni Iommi's band....no doubt. He ownes soul right to Sabbath. He's the only member left and he changed the named to Heaven And Hell but kept bascially the line up of the Dio years. Bill Ward did not play on Mob Rules or Dehumanzier. And Dio just took Ozzy's place after Ozzy left so, why is Ozzy even suing? He's the one who left. And I for one think Dio is a way better vocalist than Ozzy as well as a song wrtier.

All 4 of them are and all 4 of them should own the name and all that comes from it. They were the shit way before Dio and will be way after Dio. I have to say Tony's a bit of dick for shafting the other dudes from sabbath, I mean if he'd included Geezer and Bill in the copywrite it would have been cool. For all of Ozzy's whining about ownership of the name, he sure hasn't seemed all that interested in recording an album of new Sabbath material when the opportunity presented itself several years ago. Ozzy thought a new album would "harm the Sabbath legacy" if it failed. Can't think of anything hurting the Sabbath legacy more than Ozzy suing his former bandmate over ownership of a band's name which he had very little to do with in the past thirty years.

While I understand how many of you hold the opinion that ths all has to do with Sharon, while Ozzy seems like a bumbling fool on TV, he hasn't totally lost his marbles. I'm sure his many lawyers also had a part in this. Give the guy some fucking credit.

I'm not a lawyer but:
A. Iommi bought out all the other shares of the band back when they wanted nothing to do with the band. Whether you think that's fair or not now is irrelevant. If any of the band members want their shares back... PAY the man. By filing this lawsuit we can conclude that Ozzy wants his share back for FREE.
B. Since Ozzy has no legal ownership to the trademark I imagine he's trying to:
1) make the case that, because he has contributed to enhancing the band's prestige since he lost part ownership of the trademark (through Reunion-Ozzfests 1997-2006), he deserves some additional compensation.
2) show how his persona/name and black sabbath are one and the same, thus invalidating Iommi's ownership of the trademark.
These are difficult points to prove. First, Black Sabbath had a platinum record with Dio (H&H), as well as a Gold record (Mob Rules). They also had reasonably strong sales with other records (Live Evil, Born Again, Headless Cross). To say Black Sabbath w/o Ozzy was not successful is without foundation.
Secondly, the great popularity of Heaven & Hell (the group) is another testament that the Dio years in Sabbath were (and continue to be) highly regarded.
Finally, that Black Sabbath regained some prestige with Ozzy is undeniable. But if Ozzy did not rejoin the band in '97 a lot of other things could also have happened that would also have raised their prestige... for instance, other records with Dio. That is, Ozzy wasn't necessary for this resurgence in popularity. Also it's worth pointing out that a lot of Sabbath's regained credibility was largely due to so many mainstream metal bands celebrating them as influences, during the late 90's to today.

If you walk into a BMW dealership and ask for a new car, but only want to offer $1000, the dealership is most likely going to turn you down. It's irrelevant what was offered. The car dealership has ownership of the car and they can sell it as they see fit. You don't turn around and question who has legal ownership of the thing.
Likewise with Iommi. He owns the name. Ozzy either wants it back for free (by virtue of all the supposed "goodwill" he's helped create over 1997-2006), or he offered much less than Iommi wants. If Ozzy wants it badly enough he can buy it (I'm sure Iommi will accept a small fortune). It has nothing to do about "fairness" or "deserving." If he wants it, he has to pay.
Instead, Ozzy wants to cheap out and try to take his share by challenging Iommi's legal property rights. The court is not going to say "Iommi, you must sell your trademark for X dollars to Ozzy". It will either validate or invalidate Iommi's legal ownership of it. If Ozzy is victorious, he will end up getting the trademark without paying Iommi ANY compensation. It's not quite free (b/c of legal costs) but that's a semantic point.

Tony changed the name because Dio, Geezer and Tony didn't want fans showing up expecting songs from the Ozzy years.
They are doing the honest thing by not misleading the fans ala John Osbourne......who has been talking about a new Sabbath record almost as long as Axl was talking about releasing Chinese Democracy.
Ozzy had his chance this year and last to get together with Tony, Geezer and Bill to do a new album but chose to do commercials for Warcraft and cell phones instead.

While Ozzy is probably correct that his management had a large hand in Sabbath's financial success, these last 10 years, I dont think the trademark should be split all 4 ways. This has always been Iommi's band (yeah, yeah, I know he left around 40 years ago to join Jethro Tull...). And if Ozzy cared so damn much about the Sabbath legacy then why didnt he even *attempt* to get the 'band back together' during the "floundering" (not creatively, but financially) Tony Martin years? Prior to the 97, I mean. Had he made a real attempt to reach out to Iommi Im sure Iommi would have come to his senses and realized itd be the best thing financially and for the fans. But Ozzy was more concerned with his own solo career at that time. But perhaps not coincidentally he only cared to rejoin the band when his solo career got stale. But more important than all of that is this: Iommi has wanted to release a new Sabbath album practically since they got back together. Ozzy, on the other hand, has essentially been the roadblock to a new album. Sure, hes always been interested in seeing a new one released. And Im sure hes put some effort into it. But hes nevertheless been that roadblock. Since the songs "werent good enough" to him. Whether the reason is good or not, its his fault a new album hasnt been released yet. Yet he wants to claim equal ownership?? Sabbath could have made a KILLING with a new album, and subsequent tours, not to mention what itd do for their legacy (if the album turned out to be solid). Also, Ozzy has always been the weak link live. Its because of him that Sabbath hardly ever did anything past 'Vol. IV'. Because he just couldnt sing songs like 'Hole in the Sky'. Even 'Supernaut', a killer track from Vol. IV, was hardly ever done. So they had practically the same setlist every single tour. And even with those songs he often messed up live. Also, Sabbath could never go on longer than 90 min. And more than 12 or 13 songs each show. And has been said many times before, he hardly wrote anything in his first stint with the band. No one expects him to pick up a guitar and create riffs, but he should have created alot of the lyrics.

And Heaven and Hell might have even been more successful than 'Sabotage' (which is my favorite album of all time, along with Amorphis's classic 'Elegy').

One thing you must understand, is that post 'Born Again' Sabbath in the 80's, was supposed to be solo Iommi. The record label forced him to use the Sabbath name because, like Rose, Iommi owned the rights to the name. After that, there was no turning back.
Being that the Dio era Sabbath is touring under the name of Heaven and Hell, there is no need for any of this. Ozzy/Sharron are completely out of line in doing this. Unless it's to have more control over future "Best Of" collections, it makes no sense.
From what I understand, Ozzy isn't disputing royalties. This is just a control issue over the Black Sabbath name, and this late in the game, it seems completely out of line.
It just drags Ozzy even further through the mud, and ruins his legend. Well, what's left of it.

Although I have nothing against Dio to me (and a lot of others) Black Sabbath = Osbourne/Iommi/Ward/Butler. When BS reformed for Ozzfest there were a bunch of people who had ignored Ozzfest previously who were all OMG I GOTTA GO SEE BLACK SABBATH. Sharon may be unbelievably greedy but she's not stupid. That being said this lawsuit makes me sad, a reminder that in the end the music business is just that--a business. Whoever wins this, it doesn't matter because it's the fans of Sabbath who've lost.

He should get his due for what he did when he was in the band, the same as the other guys, and Iommi has ALWAYS been there and undergone the ups and downs a band like this has throughout their career, so he should get more than the rest at least, and he has been sensible enough so as to leave them manage the webpage and the merchandise involved even if it didn´t belong to Ozzy´s age, wtf? The reality is that the name would be shared amongst the four of them had they not sold their shares to Iommi in the 80s. If Black Sabbath should be split between the four of them, they should all pay Tony Iommi current market value of the name.
This isn't a bizarre popularity contest. It's based upon contractual obligations and the common rule of law. Iommi owns "Black Sabbath", as a music making, cd/dvd/t-shirt making entity, period. He has the documentation backing him up, and that's all that matters. It doesn't matter how popular Ozzy may be, have been, or will be. It doesn't matter whether he gives a flying fuck about his former bandmates. What matters is that Tony Iommi paid REAL money to Osbourne, Butler, and Ward for the ownership of the name; or they just gave it away.
Either way, he owns the name "Black Sabbath".
David Ellefson sued Dave Mustaine over a similar thing some years ago, and that was thrown out of court. I can't imagine that this won't be.

It has always been his viewpoint that Black Sabbath ended when he left the band after Never Say Die and that simply is not true. ANSWER: Because Ozzy can't sue on Butler and Wards' behalf. If he wins the share he is seeking, he'd have every right to then bestow any portion of that share to anyone else, including Butler and Ward.
PROBLEM: If that's what Ozzy REALLY wants, then he should be suing for 75%, not 50%. That way, Iommi would be left with 25%, and Ozzy could (acting in good faith) split his 75% in 3 equal shares between himself, Butler, and Ward. End result? All 4 would have equal ownership of the name. This makes me question his real plans. Or should I say, SHARON'S plans...

Anyway, about royalties/name rights, another thing could be that, in this digital downloading era where album sales are plummeting - especially for those albums released YEARS ago, the name 'BLACK SABBATH' has real value as a MERCHANDISING tool; Any Black Sabbath-branded swag means a cut for whoever owns that name.
I'm betting $haron's motive comes from knowing that Ozzy's long-term financial future lies not in dwindling album sales, but in selling branded merchandise, in which case, the only thing better than owning ALL the rights to 'Ozzy' swag would be owning a big chunk of Sabbath swag sales as well.

yeah, management and image, that's all that ozzy is, at least now, But if he thinks that those are the elements that brought sabbath to success, he's way out of line. The fact that Tony pretty much invented a musical genre and a way of playing riffs, let alone that he wrote 98% of the music (and a good part of lyrics too, geezer wasn't the only lyricist), plus the fact that he's he only one to carry the torch thrugh the obscure years, should gave him the rights to the name. And he's so greedy and egomaniac that, although he's the main composer, from '69 to '79 the original four sabbath always shared the rights equally, 25% each. They still earn a lot of money from the rights to song they never wrote, from songs that he wrote. Every time a radio passes After Forever they all cash in, but he wrote both music and lyrics. What a greedy bastards is tony iommi, thank god we have ozzy to claim justice.

When everything is said and done Ozzy is not liing about anything. Do you really think they were happy playing clubs vs 50 000 seat staduims that sold out? Ozyy deserves 1/4th of the name and nothing more. He is suing for 50% because if he asked for 1/4th off the top he would have to take this all the way through the court system. By asking for 50% he then allows for them to negotiate down.
As for Ozzy being a sellout? Well if if people stopped downloading albums then bands and record labels would not have to create reality tv shows, sell songs to video games, into movies, and tv shows, get paid to go on Amercian Idol "Slash" etc.

This does really suck, as it most certainly destroys any opportunity for a final go-round with the original 4. Greed destroys everything good.
Does anyone remember the Ozzy press release that came out around the first Heaven & Hell tours? The one that promised a new Sabbath studio album, tour, etc with the original lineup? We all saw what happened with that...It reeks of a jealous old boyfriend trying to get the attention of his old flame - In 2 years, H&H has embarked on multiple world tours and released an amazing new studio album, and nobody really seems interested in what poor old Ozzy's up to now.
But the bottom line is Ozzy is a narcotic fueled, parkinson's driven old man who has no control over his own business practices. This is 100% Sharon Osbourne. Just when I thought that she couldn't do any more to destroy Ozzy's credibility, I'm proven wrong with news like this. BTW - How's that new variety show going Ozzy? "

So now he wants to own everything with the name Black Sabbath on it. Why, so he can erase H+H, Mob Rules, Live Evil, Dehumanizer and all of the other non- ozzy albums. Also the plan is to have Geezer go against Iommi, thus breaking up Heaven and Hell, just like the Osbourne slime did in 1992, again right in the middle of the tour. I used to have respect for Ozzy, but this is a pathetic attempt to get attention for Osbourne, Inc. because Iommi and Butler just released an amazing new (Black Sabbath) album with Dio. The first 6 Sabbath albums are absolutely amazing, but the last 2 albums they did with Ozzy (Technical Ecstacy and Never Say Die) were crap at best. Dio brought Sabbath new life when he joined, and Iommi carried the Sabbath name on his back through all the lineup changes and ups and downs that followed. I saw Ozzy last year and the show was pathetic - on the other hand, I saw Heaven and Hell twice live and it was amazing. Very sad, because the 4 times I've seen the original lineup of Sabbath perform together it was incredible. But I hope that Iommi wins this lawsuit (aka a pathetic excuse for publicity) and continues to release quality music with Dio as Sabbath's lead singer. Ozzy hasn't released a good album in over a decade, and if he really wanted to buckle down and do a great new Sabbath record with the original lineup he could have made that happen YEARS ago. There are many great musicians who have contributed to Sabbath over it's 40 year career, and Ozzy just wants to pretend that the great music Iommi released without him never happened. Very pathetic indeed....the fans know better Ozzy. And Sharon, you obviously have ZERO integrity - go fuck yourself.

I would suspect the success of H&H to be a motivator for Sharon to do this. But after almost 12 years since the reunion began what case is there to hold?
Never heard of Bill or Geezer complaining; everyone still gets royalties. And of all people; Ozzy and Sharon probably have made enough money in the last 7 years on TV and the last 14 years for Ozzfest to live quite happily.
Oh well... it was nice seeing Black Sabbath a few times when I did during the Ozzfest years.

Tony kept the band going thru Black Sabbaths half light era of the late 80’s and 90’s he secured the rights from the original members to the name “Black Sabbath” to do so and unless there was some sort of agreement at the time that they reformed as the “Original Black Sabbath” Tony can do as he wishes with the name Black Sabbath. Of any of the original members he has done the most over time to keep the band alive. And is there anyone who really believes that Tony would leave the other members in limbo in the event of his death or whatever? That is plain silly. This is about control of the back catalog, nothing more, nothing less, right Sharon?

Tony owns the brand/name Black Sabbath, it seems like common knowledge that Tony bought out the original band mates at some point, yes?. But then, this lawsuit claims that Tony falsely listed himself as the sole owner of the Black Sabbath mark, and this lawsuit hopes to cancel Tony's U.S. trademark on the basis that it was fraudulently obtained and maintained by Iommi.
Also, right up there in the beginning of the lawsuit it says that "since at least 1997, Ozzy, without any significant input from Iommi, has exercised control over the quality of the goods and services marketed under the Black Sabbath mark."
Doesn't that seem like an unlawful act by Ozzy? Seeing as he acknowledges he doesn't own squat? Maybe he means the Ozzfest co-branded merch, which Iommi and Ozzy agreed to split 50/50.
Then Iommi sues (or issues a cease and desist order) Livenation/Signatures over some merchandising deal that Ozzy and Iommi were both party to. Im guessing it was some how related to Ozzfest shirts.
It really seems like this whole thing grew out of that one merchandising deal gone sour, the one Tony filed his lawsuit over. And now Ozzy want 50% of all things Black Sabbath?
At best, Ozzy can claim that he owns the rights to his own likeness, and that he deserves a cut of merch bearing his likeness.
Again, this isn't about royalties paid to the musicians on the records. This is about merchandise, or as it says in the lawsuit "exploiting the mark" . Well said actually, cause if sharon gets her way nothing short of exploitation can we expect.

what if geezer doesnt want his share? does ozzy keep it? give it to iommi? come on, that makes no sense. you cant say "i cant sue in your name so ill just sue for more than my share and then ill give it to you". if that made any sense that is essentially suing in his name. cause if he sued for 75% his reasoning would be "it belongs to all 3 of us" and yet only he is suing. he's making the claim for an extra 50% on behalf of the other 2.
if ozzy wants his fair share, 25%, he should be suing for 25%. now if bill or geezer want their share, they can sue for their 25% each on their own, or if they dont want to, they dont have to. suing for 75% would be bizarre, suing for 50% is damn near nonsensical, if he REALLY wants to share it 4 ways.

Wow, I never thought that this type of thing would happen between Sabbath. I disagree with Ozzy's vocals being the main reason why Sabbath was so popular (with all respect to Ozzy), music just changes when a member of the band leaves with a replacement.
There is countless numbers of bands out there who have lost a member and it has changed the sound and style dramatically, that shit just happens.
As for the issue within itself; I do think that all members of the band should equally share ownership between them and their families because Black Sabbath is only as good as all members of the band, not just Tony Iommi.

But regardless if Ozzy did 5% or 100% of the work, he's still a member of the original Sabbath and I think the 4 who started out as Black Sabbath should all get equal shares.
Someone up there asked why Dio isn't mentioned, I thik it's because he wasn't one of the original members of Sabbath. They had probably more success as Sabbath with Ozzy, then without. I mean, when you think of Sabbath, do ya really think of Dio before Ozzy?

Ozzy has royalties from his time, but he can go fuck himself if he wants part of the Sabbath name itself. The document quotes their entry to 'The Rock and Roll Hall of Fame' as important, but that's just industry cock-sucking commercial bullshit that's of no significance here.
The name belongs to Tony, by all accounts it sounds as if he's been overly generous if he's shared any takings from the Black Sabbath name since 1997. Remember, this is the name, not royalties - it's got fuck all to do with Ozzy Osbourne.

But, in his defence, at least they called it Heaven & Hell. I don't care for Dio singing with Black Sabbath. Tony tried doing the Iommi-led Sabbath thing, but it always seemed substandard without at least 3/4ths of the original band. They all need each other to be Black Sabbath. And fucking Ozzy's camp need to grow up and not being dicks about who "owns" Sabbath.

Has a little to do with this controversy, but not so much...
Below is a link is an 1986 interview with Tony on some little show where the interviewer asks some rather pointed questions about the use of the name "Black Sabbath" amidst a lot of member turmoil, etc...At first blush it's hard to take seriously this guy with a very bad hairdo and radio DJ manner, but stick with it...he really asks some good questions, and Tony seems pretty honest in his responses.. keep in mind, back in those days Tony was still hoping for an imminent reunion with Ozzy...

I have read Ozzy's statement and the entire document submitted to the New York court. If it is correct and there is nothing more "behind the scenes" then why didn't the other band members say something back in 1999 and 2000 when Tony got the ownership? If they didn't know about it, then Mr. Iommi hamstrung the rest of the band. But I find this hard to believe. You can't tell me the band did not discuss the big money involved and who gets what when they decided to reunite back around 1997. So, there might be more 'behind the scenes" stuff that the public doesn't know about. Nobody has heard Tony Iommi's side to Ozzy's lawsuti yet.
My understanding was that somewhere around 1986 Tony Iommi bought the name Black Sabbath and rights to it. It cost him quite a bit. But at that time it's value was at a bargain price. If this is correct then Ozzy has not a leg to stand on and is really showing his ass.

i know about the Iommi thing, the record company forced him. but still i dont understand all the hate over Ozzy doing some tv bullshit stuff, i dont like it very much but also i dont let it get in the way of his music or make me suddenly stop liking his music. Ozzy has made some great albums, and his last few albums have been ok to good, Black Rain and Ozzmozis especialy if you give them enough time they are very good albums and many times better then the last few Dio albums. but Heaven and Hell are great!

I think this lawsuit has to do with the success that Heaven and Hell has had. I know that Ozzy has always disliked Dio in Sabbath, because of the fact that Dio replaced him as the immediate lead vocalist, and the Dio material was successful. To put it another way, Tony Iommi could be singing with anybody else: Rob Halford, Tony Martin, Ian Gillan--and I doubt Ozzy would care. But when he performs with Dio, I know that bothers him. With that being said, I don't think Ozzy can win. Ozzy could have possibly won in the 1980s, when Tony first secured rights to the band. But after twenty years? Good luck!

Ozzy PREVENTED Sabbath from recording any new material for ten years. The only reasons Ozzy accepted to re-join Sabbath in the first place were to increase his own credibility and use Sabbath to sell HIS Ozzfest! While releasing a handful of his own albums, doing TV shows and countless solo tours; the only time Ozzy would do anything with Sabbath was to play gigs in only major markets just to increase his prestige as the singer of the biggest band in metal - a prestige he uses to sell all his solo endeavors.
The fact is Ozzy's lack of commitment to that band has once again got him replaced by Dio.
Sharon's "Controlling of quality services"? Since when does hiring a band to play your festival give you ownership of the band?? Since when does hijacking a band's website give you ownership of their name?? We all know that for years, whenever you logged on to blacksabbath.com, you got bounced to the Ozzfest site - even if Sabbath was not playing there.
I think the entire metal world should rally behind Iommi on this one.
Iommi stands for Sabbath. Ozzy stands for greed. Buy the new Heaven and Hell album! Go to the show! Screw Sharon for once again putting money before music!

I agree with you on the shares. and i like Ozzy Black Sabbath more but still Dio Sabbath is good also, but the first 4-6 Sabbath albums are all better in my opinion. ok maybe Ozzy dont like Dio but why should he be jelous? Ozzy made more money solo then with Sabbath and Ozzy has been making music in the last 10 years and so have Iommi, Geezer and Ward. and Ozzy has more talent in his little finger then all the people compared here in blabberouth have in their whole body, myself included. great singer and great entertainer. and he seems to have a great ar for great song and great players.

He doesn't want 50%, but if it has to come down to bartering, you have to ask for more than what you want/expect (Ozzy) and offer less than what you expect to give (Iommi). That's business.

ok maybe Ozzy dont like Dio but why should he be jelous?
In a sense, maybe he shouldn't be, but here's why he is. The last two Black Sabbath albums with Ozzy, Technical Ecstasy and Never Say Die, were not great sellers. So Ozzy gets booted out, and Dio comes in. I'm sure Ozzy was thinking in the back of his head, "This'll never work, and they'll come back to me." Well, "Heaven and Hell" went platinum and "Mob Rules" went gold. What it showed people--and certainly Ozzy, even though he'll never admit to it--is that Black Sabbath could survive without him. And since Dio was the frontman at the time, that's why he's jealous of him. No, Ozzy shouldn't be, considering his success, but deep down, he is. I think Dio said it once best in an interview: "Ozzy always hated me, when I was in Black Sabbath, and always liked me, when I wasn't."

so since ozzy's logic is that he contributed so much to sabbath and they wouldnt be where they got to without him, so therefore he owns the name....
i think ozzy should give 75% of his name to the family of randy rhoads, bob daisley, and lee kerslake. whos with me?

Techical Ecstacy and Never Say Die arent that great records and it wasnt Ozzy's fault right? because he didnt do anything right? or at least thats what most people here say. and he and the others were getting too deep down in drugs and alcohol. and the "normal" people who dont care had found some younger bands instead, it happens every 5-10 years depends on when you start and all that. but still its right, Ozzy never liked Dio in Sabbath, maybe its also because its a very different Sabbath and different kind of good in my view. they should have called it Heaven and Hell right there in the beginning.

NO FUCKING WAY.
ozzy owes his solo career to rhoads, daisley and kerslake.
so if ozzy wants 25% of sabbath he better give 75% of his solo band to rhoads's family, daisley, and kerslake.

I haven't heard on here anyone trying to say that Ozzy doesn't have anything to do with the failings of "Technical Ecstasy" or "Never Say Die," since you're only as good as the people you play with. With that being said, based on the logic Ozzy seems to have, wouldn't it be fair to give Tony Martin a percentage of Black Sabbath, since he was their second longest front-man?

Has Ozzy/Sharon completely lost the plot? Let's put this in real life terms, imagine I work for a very succesful company and I quit or get fired. Could I really expect to start up my own company with the same name just because I used to work there? No, I'd be sued shitless.

This has Sharon Osbourne's fingerprints all over it.She's nothing less than her father in drag.It's clear who cracks the whip in Ozzy's personal,family and professional life and it's no coincidence that his career took a nose dive which started in 1982 when they married. First the slimy remasters affair which had the original bass and drums tracks rerecorded to weasel out of royalty payments(Sharon) and now this frivilous lawsuit. Let me make it perfectly clear..You can take Ozzy,Bill,Dio,Gillan,Hughes,Gillen,Donato,Martin and even Geezer out of the band and it will still be Black Sabbath.Take Iommi out of the equation and there is NO Sabbath. Tony Iommi is Black Sabbath and if you doubt that,please picture the band without him. F**k you,Sharon.
