Will The Real THE FALLEN Please Stand Up?

The new band featuring original EVANESCENCE members Ben Moody (guitar) and John LeCompt (guitar) and Rocky Gray (drums) along with "American Idol" powerhouse vocalist Carly Smithson has reportedly been slapped with a cease-and-desist notice over its use of THE FALLEN moniker. (Note: The Moody / Smithson project has since re-branded itself as WE ARE THE FALLEN.) Alfadog Music, which represents Philadelphia, Pennsylvania's THE FALLEN, said in a statement, "We are truly sorry for the confusion that stemmed [last week] from an unexpected announcement from SKH Music [the management of Moody and Smithson's new group]. The band will continue to bring their music to the fans and perform as THE FALLEN." Philadelphia's THE FALLEN ( MySpace page) was formed in late 2005 as an experimental project by musicians Gabe Horning and Mark Bolger. The band released its debut album, "Between The Devil And The Deep Blue Sea", in August 2008. A follow-up effort, "Between The Angels And The Deep Dark Sky", came out last week. Neither Pennsylvania's THE FALLEN nor WE ARE THE FALLEN is to be confused with the Orange County, California-based act — and Metal Blade recording artist — THE FALLEN ( MySpace page) which formed more than 15 years ago and released "numerous CDs and demos" under that name. According to a letter that was sent to WE ARE THE FALLEN's management last week (and which was subsequently forwarded to BLABBERMOUTH.NET), Metal Blade's THE FALLEN "has been dormant for a few years but is preparing a comeback and new album with the popularity of metal at a new high." whoever decided to use that headline should be fired for an appalling lack of creativity. They could at least try to hire people with some sort of english/journalism background. I guess its symbolic of the overall lack of creativity in the music business as a whole

It is pretty unoriginal. The thing about music these days is that no one can make generic metal/rock/pop/etc. anymore. We've reached a point where there are too many bands, and riffs, and ideas, and everything that sooner or later these things will happen. Quite pathetic these people don't have an imagination.

To Mr. Moody:
WE ARE FALLEN? Is that the best you can do? I mean you already named your band after an Evanescence album with Amy Lee's face taking up the entire cover which you destroyed your platinum record plaques of. So now the only band name you can think of is "The Fallen" but oh n... it is We Are Fallen now which even lame.
The Fallen = lame band name showing you honestly are pathetic and haven not moved on from the whole Evanescence thing that happened like 6 years ago and writing songs for Avril Lavigne must not have taken off like it should.
We Are The Fallen - sounds even more ridiculous like you just picked it out of thin air in 30 seconds... oh wait you did...
This whole thing seems like Ben "Butt Hurt" Moody crying for leaving Evanescence (he left on his own) causing him to lose millions of dollars. The man walked out on Evanescene during a tour which is the most unprofessional thing to do thus screwing over fans that paid to see his band. He could have at least pulled a Scott Weilend and finished the tour.
Now he thinks he can grab some American Idol reject and create another hit band. Nothing but $$$ in his eyes and mind and it is hard to believe any music he creates is honest and has any integrity. He is a chump who without Amy Lee would be broke flipping burgers.
I think the lamest part is the American Idol reject for falling for this obvious lame attempt at trying to recreate
Evanescence and live in the shadow of the former band and jumping on the whole Nightwish, Epica, etc. band wagon trying to cash in.
My favorite! This idea takes the cake... roughly quoted.. "We are NOT going to record and album but release 1 or 2 tracks every 8 weeks and after end of a year or so compile them into some special cd for the hardcore fans"
HA! HA! HA! How the hell do you think anyone is going to pay to see you without having any MUSIC out??!! You think you are going to be some huge band off of the sad credibilty from your previous projects or American Idol? Good luck!

Uhh, Ben Moody made a lot of money from Evan when he left. Ever heard of publishing royalties. Plus he has worked with many artists outside of Evan.
He probably made more money than Amy Lee did.

interesting how The Fallen from Philly has an album named "Between The Devil And The Deep Blue Sea", got their name stolen by a female fronted rock band, who is a reformation of Evanescence, who a lot of people compare to Nightwish, who have a song called "Devil and the Deep Dark Ocean". preetttyy similar...

Hey Guys. I was in Evanescence and am in this band now and it's totally different. No reason to bag on Ben or say we're a rip off. Just give us a chance to show you how metal we can be. We'll write some kick ass songs and you'll all eat your words. So Carly's not Amy. She still has a good voice and Ben can still write good songs. Just cause he wrote for Avril doesnt mean he can't rock. There's room for more than one rock star out there. You'll see. JL

The Fallen? Is this a goof? Is this the only way Ben Moody can get back at Amy for having all the success? This is bad karaoke. Posers. I've seen better tribute bands that at least admit what they are. Original? Why are they playing Evanescence songs then? LeCompt is one of the most mediocre guitar players anywhere. I don't see that LeCompt wrote any Evanescence songs either. And Ben Moody sucks. Sounds like he couldn't cut it in Evanescence so he dropped out and wrote songs for Celine Dion and Kelly Clarkson, another American Idol puppet. Total pathetic crap. Still not sure if this is a joke. Either way, it's laughable.
