BLACK SABBATH's TONY IOMMI Signs Deal To Score Horror Movie Franchise

According to The Hollywood Reporter, Next Films — the newly formed film-production company launched by top reality TV producer Mike Fleiss — has signed a deal with BLACK SABBATH guitarist-songwriter Tony Iommi for "Black Sabbath", a horror movie franchise. The films won't be about the group but will use the title as a jumping-off point. Iommi also will score the movies. As previously reported, Ozzy Osbourne filed a lawsuit against Iommi in May, claiming that the guitarist illegally took sole ownership of BLACK SABBATH's name in a filing with the U.S. Patent and Trademark Office. Osbourne is suing Iommi for a 50 percent interest in the "Black Sabbath" trademark, along with a portion of Iommi's profits from use of the name. The Manhattan federal court suit also charges that Osbourne's "signature lead vocals" are largely responsible for the band's "extraordinary success," noting that its popularity plummeted during his absence from 1980 through 1996. Ozzy's suit follows one filed by Iommi in December 2008 against Live Nation. In that filing, Iommi claims the concert giant sold merchandise bearing the band's logo, despite the 2006 expiration of a merchandising deal, reportedly worth nearly $80 million. Soon after that agreement concluded, Iommi reclaimed the band's trademark. Iommi's suit argues Live Nation continued to sell more than 100 items of merchandise featuring the band's likeness, name and logo, despite the receipt of cease-and-desist orders from the guitarist's camp. Iommi's suit seeks damages in the amount of three times the profits from the merchandise sales, plus a halt to the BLACK SABBATH product sales.

But didn't Heaven and Hell beat out the last few Ozzy albums? Why is that "From 1980 - 1996" thing always mentioned? I viewed Sabbath's decline as natural for a band who had been around roughly 12 years by 1980. Few bands are popular for their entire career.

I won't dispute that Rhoads was pretty damn good, but any musicians first 10 albums are going to be better than the later albums. Your argument in favor of Ozzy has nothing to do with Ozzy at all, it's Iommi, after he's already used up 8 albums of great material, vs Rhoads.
Ozzy Ozzbourne was the worst Black Sabbath vocalist to appear on an album. The first 8 albums were still great, probably even their best, but Ozzy contributed nothing positive to any of them.

Sales =/= quality
Ozzy's high sales can be attributed more of his status as a joke icon in his TV show. Plus Ozzy's name is well known while Heaven and Hell was the first album by this band under that name. Had it been labeled as a Black Sabbath Album it would have sold twice as many.

So much about album sales figures? Obviously the artists should, but as a consumer/"fan" you either like something or you don't.
Checkout these stats from Wikipedia regarding Michael Jackson's Thriller : " On March 6, 2009 Thriller was certified 28x Platinum by the Recording Industry Association of America, for shipments of at least 28 million copies in the US giving it Double Diamond Award status there.The album topped the charts in many countries, sold 3.7 million copies in the UK,2.5 million in Japan and went 14x Platinum in Australia. Still popular today, Thriller sells an estimated 130,000 copies in the US per year; it reached number two in the US Catalog charts in February 2003 and number 39 in the UK in March 2007.The album is cited as having sold between 47 and 110 million copies worldwide; the Guinness Book of World Records lists Thriller as having sold 65 million copies as of 2007 "
Now beat that OZZY, you trendy bastard. LOL.
The fact is that 100% of the things I like will never sell like Michael Jackson's Thriller and I could give a damn about it. Average, everyday JoeBlows will never hold an appreciation for anything that's halfway worth a fuck and the success of Michael Jackson's Thriller is only a testament to the herd-mentality which permiates throughout the world, although admitedly America is far and away the most guilty. To a lesser degree the sales of Ozzy's Black Rain should be attributed to this because that's what Ozzy has become - A sham, a franchise for the public to latch onto without the integrity of days passed. $$$. All style, no substance.

I think you missed the point pinpals was making when he talked about Ozzy's status. He was talking about Ozzy's status over the last 10 years or so not back in the early 80's when Ozzy was not an American household name like he is now. You make a good point about Ozzy out selling a Dio fronted Sabbath from long ago but it's a point everyone should know by now. YOUR logic (or lack there of) on pinpals post takes a "hit" there bro. To be clear again here on blabbermouth (although it does no good to always point this out) album sales and popularity does not always make for a good or great album. That goes for Ozzy or Heaven and Hell or any other band for that matter.

I was referring to the fact that Jackson was made big primarily by the American media and record-buying public when Thriller first came out. I fail to see what your point is. Perhaps my sentance should've read differently. Americans are far and away the most guilty of the 'monkey-see, monkey-do' actions which typify a herd. That has nothing to do with Michael Jackson doing shows in London, obviously. My point was that I could give a rat's ass about album sales being a large factor when judging whether an album or band is good or not since the majority of the public, particularly in the United States would listen to some crummy, gimmicked-up rap artist which lacks both artistic quality and integrity. Perhaps it was wrong to use Michael Jackson as an example, as Thriller is a legitimate milestone of sorts. I dunno. What then, sir are your favorite bands and how well do their CDs sell here in the good ol' USA? Do you judge what you lsten to by how many jocks or computer nerds you attend 8th grade with like?

This whole thing sounds like a bad joke. Ozzy (read: Sharon Osbourne) is a disgrace to the whole music business. All she cares about is her own personal gain no matter what.

This is going to be cool and who gives a damn about Michael Jackson. Ozzy was a great vocalist, I will admit he isn't as good as he used to be but he is still out there kicking ass. Not bad for a guy in his sixties who has been in numerous accidents and done mountains of drugs. It is to bad that Oz has to file a lawsuit against Tony, its like when they where kids and Tony use to beat him up. In someway they are always fighting. Anyone that thinks Ozzy's vocals on those early Sabbath albums was terrible is just stupid. His voice was as much a part of the music as Tony's playing or Geezer's playing. Ozzy's vocals on the Sabbath stuff was incredible. Haunting, bluesy and powerful. Just like the music, go listen to Megalomania!

Hope Ozzy wins the lawsuit. Iommi can't handle the name Black Sabbath. He has proven that over the years and as soon as he's out of the spotlight or want more money he will misuse it again. Ozzy does perhaps not deserve it but the world is a better place with him having half of the control. Best would of course be that the four go 25% each.

Yeah, ozzy sells more records, what a surprise! with that kind of media coverage,even farts recorded on tape would sell. And yes, in the '80s ozzy released great albums, with music by randy rhoads and lyrics by bob daisly. As sabbath were great in the '70s, with music by iommi and lyrics by butler.

So they sold a little more than a hundred shirts or whatever, and Iommi is suing for 3X the profits on that? What's that amount to? A few thousand bucks, at most? Since he pocketed over 80 million bucks on the trademark deal, you'd think a few thousand bucks would be fairly meaningless. If LiveNation honored the cease-and-desist after selling a few extras, this suit is pretty pointless, and frankly, pathetic.
