Former MEGADETH Bassist Sues DAVE MUSTAINE For $18.5 Million - July 15, 2004

Former MEGADETH bassist David Ellefson has filed an $18.5-million lawsuit against the group's mainman, Dave Mustaine, in Manhattan Federal Court, alleging the singer shortchanged him on profits and backed out of a deal to turn Megadeth Inc. over to him when the band broke up in 2002, according to the New York Daily News. Ellefson also accuses Mustaine of locking him out of merchandise and publishing royalties.

"This is a classic case of a minority stockholder whose rights were abused," Ellefson's attorney, Randall Jacobs, told the New York Daily News.

In court papers, Ellefson said Mustaine — a veteran of at least 17 drug rehab stints — resented Ellefson, a former drug addict, for having kicked his own habit. It also accuses Mustaine of dissing the bassist's playing skill.

According to court papers, the battle of the band spread to the Internet in May, when Mustaine posted on Megadeth.com that Ellefson was trying to extort him.

"Did Ellefson ever once get in a fistfight with someone to protect me? No, but I did for him," Mustaine wrote. "Did he ever loan my parents money? No, but I did for him."

MEGADETH's new album, "The System Has Failed", which doesn't include any contributions from Ellefson, is scheduled for release on September 14 through Sanctuary Records.

	All Ellefson wants is his fair share and what is rightfully owed to him. He may be no Cliff Burton, but he was obviously an integral part of Megadeth. 	To Anyone Who thinks the New cd "The System Has Failed" will Suck. Think Again! It's on Kazaa and I have it. The Cd is Awesome. Some songs like "Blackmail The Universe", "Shadow of Death", "Something I'm Not", "Kick the Chair" are a Return to "Rust in Peace/Countdown to Extinction" era. A few songs are different than what Dave has done in the past, But still very cool. Songs like "Tears in a Vial", "Die Dead Enough" are Great. "Back in the Day" is an awesome Old School Metal song. That probably could've fit right onto Peace Sells or So Far, So Good, So What. The Riff is basically the same riff from Iron Maiden-Back in the Village from "Powerslave. I love this CD, i can't stop listening to it. I can't wait for it to come out so I can go Buy it and have the artwork and better sound quality. This is no doubt the Best cd that Dave Mustaine has put out in well over a Decade. It puts "Cryptic Writings", "Risk" and "The World Needs A Hero" to Shame. And can be put along side all of the other MEGADETH cd's.

	Don't Worry!! "The System Has Failed" Fuckin' Smokes. If you're a MEGADETH fan and If you liked "Cryptic Writings", "Risk" or "The World Needs a Hero" You'll Love "The System Has Failed". Most of the Cd sounds like Old School MEGADETH. There are about 2 or 3 songs that might take a few listens to get into. There are No mellow songs at all on this Cd. Overall it's a Great CD. I would give 4 out of 5 stars.

Which I have Absolutely No Problem with At all. I Love 80's Metal. 	Dave and Jr were OBVIOUSLY tight, Jr is a good bass player, Mustaine has cut loose good players before (albeit for drug problems) I have heard the entire album and its GREAT (yes Ill still buy it when it come out) On one hand you have to realize Jr stuck through with Mustaine for better or for worse and he DOES deserve SOMETHING in return for putting up with him (mustaine) But suing, and making a public spectacal of this is not the way to handle it. There needs to be a sit down between them. We dont know what Jr went through dealing with Dave (who has always been a mess) So none of us have the right to say anything till we have walked a mile in the mans shoes. 	Yeah, and how many songs wasn't Mustaine credited on so that James and co could keep the publishing to themselves? He's said all along that he was into HP Lovecraft and that "The Thing That Should Not Be" was his idea. Now this is not saying that he wrote "Master of Puppets" or "Sanitarium" or "Disposable Heroes." This is a great song that I rarely hear of Metallica playing live. Your argument for Kirk Hammett is awful too. The guy has gotten worse and worse as the years have gone by and is non-existent on St Anger. He may just be the most overrated guitarist ever. Mustaine has proven time and time again that he's a better rhythm guitarist than Hetfield and a way better lead player than Hammett could ever dream of being. There must be a reason why there are no solos on St Anger and it's not because the disc is so brilliant without them. The last time he shined was on "Bleeding Me" and before that was somewhere on AJFA. If you're going to be a giant jackass, defend a shitty band and sip the dicks of that shitty band you're getting what's coming to you. Sit down, shut up, pay attention and maybe you'll do a little better next time stupid. Find a better band.
