MEGADETH: DAVID ELLEFSON's $18.5 Million Lawsuit Dismissed

The MEGADETH lawsuit that one founder of the thrash band lodged against the other is "megadead," according to the New York Daily News. Former MEGADETH bassist David Ellefson had sued frontman Dave Mustaine for $18.5 million over the pair's bitter falling out (see previous BLABBERMOUTH.NET stories: Story#1, Story#2, Story#3). Manhattan Federal Court Judge Naomi Buchwald dismissed the lawsuit Thursday (Jan. 13), saying Ellefson had agreed to a deal to resolve their various disputes after the heavy metal act broke up in 2002. Ellefson had maintained he backed out at the last minute. The suit charged that Mustaine had been in and out of drug rehab at least 17 times and resented Ellefson because the bassist had managed to kick his own habit without a relapse. The band reformed in 2004 without Ellefson.

And if you read carefully that is refering to the "deal" that Ellefson agreed to back in 2002, that he is claiming he did not (hence the backing out part), or at least backed out of...therefore the lawsuit.
He didn't deserve a penny anyway and good riddance.

Ah, but that is where you're wrong! Dave still has a solo career to launch after Megadeth, and he told me that Shawn, Glen, and Jimmy are definitely going to be the ones playing on it.
And yeah, they are a great group of dudes, I'd say. Shawn was out there the whole 1st leg of the tour and learned the setlist in two days notice of the first gig. Glen's nailing every solo and adding so much more to them at that. And Jimmy can cover the back-up vocals just as well as Ellefson and is really cool when it comes to talking to fans.
On another note: Megadeth IS coming to the US one last time in what Dave calls "a victory lap." So buckle your shit and get ready!

Do you know him personally so you can tell? I don't think so. He has had some attitude problems during the years probably caused by unsolved things earlier in his life not least the drugs he used to take. But people can change, and people should really give him a chance, cause I think he's honestly trying to become a better person today. Though it must be very hard and frustrating to even try when having like outside people who don't really know you at all constantly juging you for things you've done in the past, I know that by own experience. Just give the guy a break, he hasn't slammed anyone in months, let's support him instead.

I think Ellefson deserved to be treated like a partner not a fucking employee. That is the feeling I get everytime I hear or read anything from Dave M. Everyone is Daves' pawn. I "made" him. No one would know of this guy, or that guy, if it wasn't for ME ME ME! (what a load of fuck!!)
Everyone that he deals with is an ingrate as far as he is concerned. Ffrom band members to the album cover artist, they are all trying to fuck him maaaaan. Everytime I read a Dave M. interview I think fuck how can he be so infantile in his thinking??!!!!! I remind myself that for every year of drug abuse he is emotioanlly stunted. So , Dave is around 14 years old. He is lucky that he is gifted and intelligent. Or he would Vince Neil LOL!!!!!!!!!!!!!!!!!
Dave M. has always been a favorite of mine! It pisses me off bad that at this age he is so "stuck", fuckin' pathetic. BIG turn off!! I hope he keeps good on his "from now on I will be more like Dime" staement. Please Dave M.
