Stage Diver At CLUTCH Concert Faces Eight Years In Prison

The Associated Press is reporting that a man charged with injuring two women when he dived off the stage at a heavy metal concert said he never realized someone in the crowd could be hurt.
Joseph Seink wept Monday (Feb. 7) while testifying in his trial on two counts of felonious assault. Authorities say two 28-year-old Cleveland women each suffered a cracked neck vertebra but no serious spinal damage when the 195-pound Seink landed on them last June 4 at Scene Pavilion downtown.
Seink, 34, of suburban Solon, said he sneaked backstage to see his favorite band, CLUTCH, and celebrated by jumping into the crowd when his favorite song began.
"The last thing I wanted was to hurt anybody," Seink testified during his one-day trial in Cuyahoga County Common Pleas Court.
He could be sentenced to two to eight years in prison if convicted of both charges, said Jamie Dalton, a spokeswoman for the county prosecutor's office.
Judge Nancy Fuerst is expected to rule Wednesday.
"He should have known he was going to hurt somebody," said Brian Deckert, an assistant county prosecutor.
Catherine Tressa and Tammie Myers both said they didn't expect someone would jump off the stage over security guards during the concert.
Witnesses told Seink's public defender, Walter Camino, that heavy metal shows are characterized by violent slam dancing. Occasionally, witnesses said, audience members dive off the stage, expecting the crowd to catch them.

Stupid fat fuckers should not be stage diving!! I hate all the pricks who stage dive or float and have combat boots on or are tubs of shit!! He was old enough to know better....I'm 6'4" 250 lbs and you'd never see me doing this shit. I'm not saying big fuckers shouldn't have fun, they just ought to have more consideration for those around them. Just my opinion.

That's why you keep you arms up! To catch people stage diving. FUCK!!! You would think these girls would have used a little bit of judgment before getting in the pit. That kind of behavior is to be expected! I broke my arm and dislocated a knee cap in the pit after falling from crowd surfing at an Iron Maiden/Anthrax show. I didn't sue anyone over that or put anyone away. It was my own stupid fault for getting trampled. I just wasn't fast enough on my feet and I paid the price. So what, a few bruises and a couple of casts later. I was fine, and I still rip it up in the pit 15 years later. I feel bad for dude. 8 years in prison?!?! That doesn't seem right. He was at a show having fun.

If you don't want to get hurt at a show, stand the f**k back. I agree that it is pretty much lame to have some drunk load stagediving anyhow, but its to be expected, like tackling at a football game, or checking at a hockey game. If you don't like it, stay off the sidelines and don't stand in front of the stage.

I always love it at the start of shows like SLAYER.....you can easily pick out the people that will be gone by the end of the first song.....it amazes me that some people think they can just pick a spot in front and hold it.....the entire crowd moves, ebbs and flows throughout the show, you have to be ready for anything

I'm just going off the report, so I don't know if there was a pit or not, but stagediving dudes need to check the crowd to see if it's "happening" or not before flying into people. Injuries at a show?? It's happened more than once and always will regardless of postings that "this or that" is not allowed. Sure, it's unfortunate and noone like getting hurt, but that is a risk when you are upfront. As much as I liked moshing and surfing, once you are over the age of 30, cease and desist!!!! Slamming is for the younger kids..

you're right, i always notice some prissy 16 yr old hot topic girls at about any show and they always run out pretty fast. most stage divers i've encountered are idiots who jump like 5 inches in the air and about kick the people in the front row. that really pisses me off. if you're going to do it actually jump and jump at the pit where people are expecting to get hit.

I agree that standing still 190 pounds isn't that big at all, depending on stature......
But when they come flying at you off of a stage or balcony, physics makes for a big change. Doesn't matter if they are 90 pounds or 300 pounds, if someone isn't paying attention, someone will get hurt.

Well on the one hand these two woman should have known what they were getting them selves into going to a Clutch show. I mean this aint Barry Manelo so you should know there's a good chance off stage diving and such.
But on the other hand I know what's its like to have a fuckin whale crowdsurf over my neck and land on my head. So I think if ya weigh more than 150ish you probably shouldn't be crowdsurfing or stage diving at all. Show some respect for the ppl your landing on.

The sports analogy wasn't aimed at people harassing other folks in the crowd. Just making a point that folks should assume that there are risks everywhere, including sporting events..football, baseball (line drives hurt like a bitch), even NASCAR when bumpers, tires, or body panels ( or parts haha!) come flying over the fence. When people choose to go to shows and they stand in front, they should assume they are at risk.

Guys, there is no right or wrong in this argument. I accept the responsibility of going to a show where I know there will be moshing/brawling/violence. It is also MY responsibility to make sure I don't get hurt. So, having said that, I'll not only watch the show, but people other than myself bent on moshing getting their proverbial asses handed to them. Sounds like fun, eh?

loosers, well these dudes probably don't really like the band they are there to see all that much. They are there to be phsycal and act like tough guys since they kow they are bigger than most. It never fails to see some kind of altercation because some idiot decided to start a moshpit while some dudes where just watching the band. So is it sign of the times ok fuck, I'll move back then its cool. I personally would like to watch the band at close quarters and have them blast the sound into my skull which is why I'm at a show for. But these loosers fuck it up for me manyy times and I'm too old to be fighting each and every itme this shit happens. Its not about being tough its about why I'm there which is to have a good time not to go and get into a fight cause if I did get into one I'd probaby slice one of these fat motherfuckers gut open and have his guts spill allover the floor.

If you don't want to be hurt, get in the back with the other people. Goddamn...just cause you're a pussy doesn't mean the other fans have to suffer. clutch might not be the heaviest band, but i could definately see someone stage diving at one of their shows. it sucks what happened to those girls, but locking the dude up for something like this is insane.

Here's a hint of wisdom... I you are over 180 lbs you need to keep your feet on the ground at shows! No one wants to carry your fat ass! Everytime a big dude is crowd surfing near me or if I get kicked in the head by a crowd surfer, I promptly grab them by the neck and bring them down head first onto the concrete.. HARD!

and if someone hit or kick me for surfing on top of them, they better fucking expect to get it back tenfold. I've had my nose broken by a stagediver, but I didn't start to cry and bitch about it, cause I was front fucking row, and stagedivers were going over me/landing on top of me all the time. I knew it would be like that, and I expect it to be. If I can't stagedive and mosh at shows, I probably wouldn't even go. Wanna hear some music? Stay home in the sofa. Don't go to shows and bother people with your bullshit attitude. And it's not about 'diving onto people enjoying a show'. It's about diving on the people in the front. They should fucking know what's coming. If they don't, then they are out of their element.

I will go where I fucking well please. If one of my bands rolls through town, I'll be there. Yes, I expect a good mosh. Most of the time it doesn't bother me at all. I know I'm far too big to jump on top of people so I don't do it. I mind my own business and I'm usually one of the dudes who picks people up and out of harms way when the fall in the pit. But if I get hit unexpectedly, I get just a little pissed. I don't cry and bitch, I simply take action. In any situation, if you hit or hurt someone (purposely or while just acting a fool) then YOU should fucking know what's coming. If you don't, then its your head to the ground.

you can go hanging out on the freeway too, but chanses are you eventually will get hit by a car, and get hurt. Comes with the territory. I get in the pit I expect people to go crazy, and I expect to catch stagedivers, just like I expect other people to catch me. On the rare occasions I don't wanna mosh/stagedive. I stand to the side, or further in the back. I don't stand in the middle of the pit drinking beer and expect no one to bump into me

if someone attack me on purpose, I will fucking hit them back. If someone dives on top of me it's part of the show. Things can go wrong when chaos ensues. Most of the times nothing happens. Occasionally someone breaks a nose or a finger or bust a knee, or whatever. No big deal

I go to 2-3 shows a week, and I do this all the time, and 99,9 % of the time there no problem. Wanna act like a pussy? stay home listening to your german power metal records.

punching people is to injure them. Pretty simple. I don't mind getting a few bruises, but if someone attacks me it's something else.
