CLUTCH Concert Stage Diver Convicted Of Lesser Counts - Feb. 9, 2005
The Associated Press is reporting that a man who dived off the stage at a CLUTCH concert, injuring two women in the crowd, was found guilty of reduced charges Wednesday (Feb. 9) and put on probation for one year.

Cuyahoga County Common Pleas Judge Nancy Fuerst convicted Joseph Seink, 34, of suburban Solon, on two misdemeanor counts of reckless assault. Seink, who agreed to a non-jury trial, could have faced eight years in prison if convicted on two counts of felonious assault.

Seink's attorney, Walter Camino, said he didn't think an appeal would be filed. "We're satisfied with the verdict," he said.

Authorities say two 28-year-old Cleveland women each suffered a cracked neck vertebra but no serious spinal damage when the 195-pound Seink landed on them last June 4 at the Scene Pavilion.

Seink said he sneaked backstage to see the band CLUTCH and celebrated by jumping into the crowd when his favorite song began.

Witnesses testified that heavy metal shows are characterized by violent slam dancing with fans occasionally diving off the stage, expecting the crowd to catch them.

The injured women, Catherine Tressa and Tammie Myers, both have said they didn't expect someone would jump off the stage during the concert.

seriously, this guy didn't deserve to go to jail, but two people going out for a good time and not bothering anybody didn't deserve to get their necks just about snapped.

I'm not exactly sure what he should have to do to make things right, but one thing in life that makes my blood boil is when somebody goes out and does something stupid/violent/reckless or whatever and somebody minding their own business, in the wrong place at the wrong time, gets fucked.

I'm guessing the ignorant females know what to expect at a concert now.

Glad to hear Stage Diving Joseph got misdemeanor counts instead of the Pen time. I would have been genuinely bummed out to hear about a stage diver doing time for having fun.

If you go to a clutch show then you should know it's not no poison glam band bullshit an moshing an stage diving is expected... you can't be a hot lookin groupie in the front row flashin tits to impress band members.... If you ask me it was the womens fault for being up front...

Anyone who gets in the pit is assuming a certain amount of risk. If you don't like stage divers, DON'T get in the pit. How much intelligence does that require? Even giving someone misdemeanor charges for doing what comes natural at a show of this type is total crap as far as I'm concerned. I guess now even the pit has to be PC for all the fucking "I'm a hippie, but I'm metal" crowd. I long for the pits of old. No broads trying to look pretty, and no kung fu- kicking, punch throwing asswipes. I'm 35, and I think all of you teenie bopper bitches could learn something from all of us "OLD" people about how to conduct yourself at a gig. My knee still gets sore from an injury sustained at an Exodus show in 85, Yet no news story has ever surfaced to immortalize my suffering.....WaaaaaH Waaaaa...

I've never heard anything by Clutch, from what I understand they're kind of a Primus ripoff. Yet that being said; they are obviously a hard rock band of some sort and last I checked crowd surfing and stage diving were staples of a hard rock show. I'm not saying this guy is not at fault I'm just saying these two chicks' saying "ooh well we didnt know people stage dive at concerts" is equivalent to somebody not paying attention at a baseball game and getting clocked with a foul ball and claiming "I didnt know balls left the park in baseball I'm pressing charges!" just food for thought

... one of the greatest bands and shows you'll ever hear. Clutch shows aren't really hard core metal pit mania. They usually work the shows that the older crowd is on the floor and the underagers get stuck up top in the seats b/c the more 21+ people. The guy probably shouldnt have done it but it doesn't give the stupid bitches the right to sue. If security let it go its obviously common.

this was a dive into the crowd at the front of the stage. IMO if you're watching a show, you shouldnt have any problem seeing a 300lb guy running off a stage 4 feet in front of you and jumping off
