KISS Issue Warning To Bootleggers: 'We Will Find You And We Will Take You Out'

The following message has been posted at the official KISS web site, KissOnline.com:
"Last August, the attorneys for KISS obtained an injunction against the sale of counterfeit KISS merchandise and seized bootleg videos of KISS concerts that were being offered for sale at a KISS Expo in North Carolina. Our attorneys (Ray Scott and William Randolph), following up on that seizure, obtained last week a permanent injunction against defendant Roy Damm and damages awarded to Kiss Catalog of $7,000,000, plus attorneys' fees.
"We hope that this judgment sends a clear message that KISS will not tolerate being ripped off by counterfeiters and bootleggers. This is also a rip-off of KISS fans who have a right to expect that when they spend their hard earned money for KISS merchandise and videos, they are getting high-quality, authorized KISS products. When you purchase bootleg videos, including bootleg DVDs marketed under the KissVision label, we ALL lose. This is our $7,000,000 warning to those who are selling counterfeit and bootleg KISS goods, that they risk the same fate as Roy Damm. We have directed the KISS attorneys to continue protecting KISS' rights as aggressively as allowed. No slaps on the wrist. We will find you and we will take you out."

To those who say "don't rip the artist off"...
how many of those videos do you think Kiss were going to/will make available to their fans? If some guy films a concert that Kiss didn't give a damn about, to a reasonable standard, and then sells it (maybe to someone who was at the gig and thought it'd be cool to see the same gig) to recoup the expense of making the video and then make a bit of money then what's the problem? As long as it's not bootlegs of genuine albums, or official DVD's/videos then why do Kiss deserve the money? Even Metallica allow bootlegs of gigs to get distribution as long as certain rules are abided by.
I fully believe that an artist should profit from their work for survival, but the extent to which Ozzy, Kiss etc push it is insane.

you have a very valid point. people who buy bootlegs probably have every kiss album released. still, it does seem wrong that someone else is profitting off them. that's why bootlegs should be reserved to free downloads and/or trades.

I agree with both sides. It's too bad to have people getting shit that they worked hard on for free. But at the same time it depends what the bootlegs are and how much money was made. I don't agree with people making shitloads off of bootlegs but if I want a video of a show I should be able to get it. Another I don't agree with is the 7 million awarded, that's pretty crazy eh? The guy must have been doing alot of bootlegging or making quite a profit, that I can understand, it's the little people that should be able to get ahold of this kind of stuff.

The people who buy the bootlegs are the same people who have ALREADY BOUGHT all the "official" stuff.
If the artist is not offering it for sale legitimately, then it's fair game. The word "fan" is short for fanatic, and a true fan wanrs all the material of their favorite band(s) they can get their mitts on.
Note to artists: If you don't want it bootlegged, release it legitimately. If you can't be bothered to release it yourself, then shut the fuck up.
Q for KI$$rules: After your rant, are you telling me you don't have a CD of Wicked Lester or any "unofficial" tour videos lying around? Yeah, right. As big a KI$$fan as you are, you have them and you know exactly what I am saying.

I don't think Kiss would have a problem with fans trading bootleg copies of concerts and that sort of thing but i think they most certainly have every right to stop some greasy business man from selling like 100's of bootleged items at expos and shit,bootlegging is huge just come to Toronto and go deep inside the Asian community and see how many illegal copies of movies, still in the theatres i might add, you can buy for dirt cheap.

Fuck you guys! I saw a band Sunday night, and the lead singer asked people to burn a few copies of their cds for their friends, and bring a tape player to their next show in the area... They sold a ton of merch that night according to their webjournal. And they thanked everyone. I got to meet the lead singer and get his autograph. He wasn't a dick at all. I love bands like that.

is that 99% of them look and sound like shit. If they really want to stop bootleggers they should follow Pearl Jam's example and just release EVERY live show they've ever done. They release them relatively cheaply ($14 for a double live cd and it's a direct soundboard recording to boot) and there's no way any vendor at a cd show can compete with it. Other bands have followed suit with issuing their own "bootleg" stuff (Dream Theater, Testament, Grateful Dead) so it's a great way to counteract it. It's good for fans and their collectors too as they have plenty of different shows to choose from.

On the last tour all the shows but a handful were recorded and you could get your cd of the show immediately after the show. The only ones that weren't recorded for Instant Live, I believe, were the ones that weren't sponsored by Clear Channel.

$immon$ didn't come after me for selling my entire KI$$ collection (Including boots) on Ebay awhile back. I did that because of the fact that I was disgusted by how he has run the band into the ground with his incessant whoring of the band name.
I think Sebastian Bach said it best on "Most Metal Moments" when he said "You know of all the KI$$ merchandise that they've put out, there is one thing that the fans really want that they haven't put out...A new album!" He's dead on there. What a joke they have become, which is sad considering the fact that they were the first band I ever got into and lead me into all of the great Hard Rock and Metal I listen to today. I'll always respect them for that, but it's getting harder by the day to respect them for anything else.
Not that Chaim cares, he's too busy counting his money somewhere and plotting to go after bootleggers.

the stuff, kiss fans will buy it, plain and simple, i own everything kiss has ever released and tonnes of bootleg audio and video, the Kissvision stuff is actually pretty good, but the moment kiss releases anything official, hey i'll gladly buy it. And i do recall Gene and Paul playing at a KISSKONVENTION where they fully allowed dealers to set up booths and sell bootlegs, even allowed people to tape the KISS unplugged performances....which ended up on bootleg. If people are Pirating Official Kiss stuff, then hey, go after those guys.
There's no way kiss will ever release a lot of really cool stuff, like the wicked lester album or the demos, so thank you to the bootleggers...and don't hold your breath for that 7 million Gene!!

I used to be a big Kiss fan,grew up listening to them and then found the heavier shit and so on,I agrre with the posters that wanna know why anybody wants bootlegs of recent Kiss,but I would be more inclined to buy early shows/demo bootlegs just for collector's sake. As much as it kills me,Gene has killed the Kiss that the fans once loved and Paul stood by and let him do it. No wonder Ace and Pete didn't stay back that long after the reunion,I'd get tired of someone rummaging through my spacesuit costume looking for spare change and mumbling shit about being the god of thunder. Happy birthday Ace! This is what happened to the band you helped prpel into what was stardom,now they're just washed up and want to make sure no one is making a dollar or two off of shit they can't control. I want to tell you all of a video I obtained about 4 years ago. It was from a KISS convention/expo in Detroit (maybe?). This was a home video shoot from someones personal camera. Anyway, the person behind the camera is filming stuff from the expo like old costumes, records, merchandise, etc. All of a sudden out of nowhere you start hearing all of this commotion from the attendees because Paul and Gene SHOWED UP to the expo unannounced to SEIZE THEIR OLD COSTUMES that were on display!! In a matter of minutes, what once was a full display of Costumes and stuff was reduced to a display with hooks and NOTHING else! They CLEANED the place OUT! People on the tape are yelling GENE!! PAUL!!! GENE!!! PAUL!! over and over again to the point of wanting to take the tape out of the VCR and throwing it out the window, but it's still one of the funniest things I'd ever seen as a fan of KISS. So in order to "appease the audience" after all the merch was taken, Paul and Gene did an on the spot Q&A and admittedly, they actually did a good job of it. Well Paul did, Gene was mostly pissed off and barely answered anything. Then a bit later on in the tape, there's a Q&A with Peter Criss that was billed as being part of the convention. Fans in the audience tell Peter what happened a few hours before he showed up with Gene and Paul seizing their stuff and he just unloads all sorts of disses against them. ALL of this about a YEAR before the 1996 reunion tour. If anyone can find this tape and wants a good laugh, try to find it. JUST HIT MUTE for a while when Gene and Paul show up to seize their shit because you will go crazy hearing this person behind the camera call out to gene and Paul over and over again as if they were going to stop dead in their tracks and talk to her on camera rather than take their stuff back.

Sure, bootlegging can be bad for business, better for others, & sure they have a right to pursue these elements, but good fucking luck! Look, as long as there is a demand or as long as there are people who will buy such items, bootlegs will exist. Same goes for the drug trade, so their war on bootlegs might have a slight impact, but overall the only people to benefit from this fight are the fucking filthy rich lawyers. The short of it: suck my balls, you greedy fucking pricks! Kiss & their affiliates have to be some of the richest people in the music business! When will they stop?!?!?!????

Roy Damm makes his living off of KISS boots...I hope they go after Peter Arquette soon..He sold so many shitty tapes back in the day for 9-10.00 a pop for a damn audio cassette...and 30.00-35.00 a VHS tape plus shipping...and that put his butt through college doing it...and still kept selling...

I own all the KISSVISION DVDs. They're great and if any of you have copies of these, it's clearly stated at the beginning of each one that "This is the only known footage...until KISS decides to give us something else..." I mean that's not verbatim, but you know what I mean.
The problem with all of this is that Gene Simmons, in some cases, doesn't have the best quality video-taped footage. KISS MY ASS proved this. The commercial footage in particular on that "Authorized" release was terrible compared to several bootlegged copies of their television commercials available on video tape back in the eighties and nineties.
The fact that KISSVISION DVDs are being targeted in particular is only because KISS is planning to release the same stuff, but "Officially." Will they remix and remaster this old stuff just like they remixed and remastered the latest "Official" DVD releases? I mean c'mon. People want this stuff and if they can get it, than good for them!
I am not in favor of this at all. I think Jerry Garcia had it right from the beginning - tape it, tape all of it and share it. Too bad more performers don't share that opinion.

As a Kiss fan that has attended many a Kiss convention, I find this ridiculous. Kiss claims that they would be nothing without the fans, well, it is the fans the purchase the bootlegs. Without some of the bootleg material to view or listen to, fans would lose interest in the band. From what I understand, the KissVision stuff, was video work that was okayed by the band but never released. Most of the KissVision stuff is great. I wish Kiss would release the KissVision releases under the Kiss banner. But they don't. So fans have no way to see alot of the classic stuff. I am not saying that the bootleggers are right, but Kiss should release this stuff under the Kiss banner and give the fans what they want instead of suing people.

The realilty is that KISS are not like other bands. Their image precludes basic ethics of fan to band relatiuons, merchandising for one. But where does all this end? Is Gene - and to a lesser extent Paul - going to alienate all the fans through his desire for MORE? It seems that he is. I've been a KISS for as long as I can remember and I've ALWAYS realised that Gene wasn't a musician - at least not in the conventional sense - He's more of a business man. If you are fan, and it's ok if you are, they did do some cool shit, then it's ok to be a fan. Concentrate on the one person on the band you like (or can stomache), move on and forget about Gene and his questionable morals. Fuck, it took me an hour to type that and now I don't even understand meself!

I have to agree with bigbuciach, KISS has scammed on their fans for decades.
I can't believe that they are arresting and suing their fans for transferring copies of concerts that KISS chose not to release. Most of the shows are great to have for collectors, but having seen many of them.... from a production standpoint they suck. KISS makes many f*ckups during the concerts including Gene singing the wrong lyrics, Ace playing wrong guitar parts, Peter forgetting the words to Beth and Paul smearing his lipstick on the first song then not fixing it for the rest of the show ( that would trash the whole video ).
Many of these shows were professionally shot but never released because they couldn't or didn't want to fix the errors. But like I said, the sad thing is that they were never made available, some people attained copies then started selling them. Most of these people don't sell them for much ( keep in mind the time and money it would take to burn copies print up nice labels etc ). I think its total bullshit that KISS would destroy someones life and announce that they will do it to everyone else. Keep in mind that the person they screwed over in this article was a friend of the band and promoted/arranged many KISS conventions in the US. Guess they had a falling out and the mighty dollar took over. I guess KISS' 15th greatest hits record hasn't been selling that well and they're trying to get money together for the next SCAB world tour.
I'm ashamed to call myself a KISS fan now...... even after following them for more than 25 years!

What I don't get is this. Sure you're pissed about people making money off of bootlegs right? Well guess who those people are?! They're your fucking fans, who gave you everything you have now, so quit your bitching! It's fucked up to attack the people who made you, plus it's pretty stupid. Lars has to this day never fully recovered from attacking fans in Napster, and he's in a much bigger band then KISS and much more popular one as well.

I can completely understand why any artist would have objections to people selling counterfeit inferior material to their fans and making a hefty profit off of it. Selling bootlegs is, no two ways about it, against the law. Now, that being said....
The KISS bootlegs that have been circulating, have been around for at least twenty years now in collector's circles. It's not secret that they're out there, nor is it a secret that most KISS fans out there own at least one or more of these bootleg concerts. The reason the fans buy this stuff is because THEY WANT IT. KISS themselves have perpetuated this by releasing official 'compilation' videos (i.e. Exposed, Extreme Close Up, etc.) that features clips from these bootlegs....yet for all these years, having known that there is a strong market for this material, they've not released it officially in full. Why? That part just never made sense to me. If you want to truly put the bootleggers out of business, then fucking release these fucking videos to the public already!! You tease the fans by showing them all these little snippets of the videos on your shitty generic compilation videos, but then you get mad when people get curious enough to go buy the bootlegs?? Meanwhile, Gene and co. are releasing crap like golf balls, wine bottles, even toilet paper with their name on it. People don't want that garbage. They want the vintage concerts, guys. Your fans have been asking for you to put out this stuff officially with remastered audio and video for twenty years now. But you instead give them toilet paper and coffins. Real smart.
Furthermore, why haven't the band and their lawyers struck out against the bootleggers like this in the past? This is not a new development, these bootlegs have been sold in vast quantities for two decades now. The only reason I can see, is that they are FINALLY going to be releasing this material "officially" and they want to make sure that the bootleggers aren't competing against them. Like I said, just give the fans what they want, and your problems are solved....you sold audio recordings of every show on the last tour, that was a good idea. Consider doing the same with video and you're on to something. Gene of all people should know that if something is that much in demand and you don't provide it, then someone else will come along and provide it instead, that's just the way it works. Gene prides himself on being this big business tycoon but damn he sure seems to be making worse and worse business decisions as the years go by. For someone so obsessed with money, he sure knows how to fucking blow it on bad business ventures.
