SLIPKNOT Threaten To Sue BURGER KING Over 'Lookalike, Soundalike' Band COQ ROQ

The Smoking Gun has issued the following report: Claiming that its image and persona have been hijacked as part of a marketing campaign for Burger King's new chicken fries, the costumed heavy metal band SLIPKNOT is threatening the fast food giant with legal action. In an August 4 letter [which can be viewed at TheSmokingGun.com], the band's lawyers charge that COQ ROQ — a mock metal band featured in new Burger King commercials — was created as a "look-alike, sound alike 'band' in order to influence the SLIPKNOT generation to purchase Chicken Fries." Counsel for the band notes that COQ ROQ — whose masked members are supposed to resemble badass chickens — has blatantly copied several of SLIPKNOT's signature masks, including a gas mask, a kabuki-style face covering, and a mask with dreadlocks attached. Details of SLIPKNOT's beef with Burger King surfaced in connection with an August 12 federal court filing made by the fast food company and its advertising firm. Burger King wants a U.S. District Court judge in Miami to issue a "declaratory judgment" that the COQ ROQ campaign does not infringe on SLIPKNOT's publicity and trademark rights. As for the similar masks, Burger King lawyers — who apparently read the metal mag Revolver — note that many groups "wear masks and/or make-up to accomplish a mask-like effect, including but not limited to the bands KISS, GWAR, INSANE CLOWN POSSE, MUSHROOMHEAD, MUDVAYNE, MARILYN MANSON, LOS STRAITJACKETS, and the SPITS." They're not great metal. I like one or two songs so I'm not dissing them but they're not metal they're rock. I agree the masks have the same image somewhat but who cares? As for soundalike , wtf? This "coq roq" {which is a pussy way of saying cock rock} sounds like some mediocre hard rock band they have like the opposite sound of slipknot. From what I've heard the fries suck. It seems to be a peice of batter with maybe one thin strand of chicken inside.

How is this ad campaign manipulating Slipknot fans to buy chicken fries, or copying something that Slipknot created? the Coq Roq songs sound nothing like slipknot and, last time I checked, bands were wearing masks and makeup waaaaaaaaaaaaaaaay before slipknot ever did. Just another example of how Slipknot and their management really need to get over themselves. I think it would be poetic justice if Kiss or Gwar turned around and sued slipknot for copying the mask idea.

Seems a bit shaky to me, too many grammatical errors, and it sounds as though it was written by a sixth grader...this whole story seems fabricated, as much as i might not enjoy slipknot, what with their arena tour ending and their club tour w/ unearth kicking into gear, i don't see them having any time to try and sue burger king...so yea, i think it's all a big sham...but that's just my take

Oh, and since CoqRoq is not actually a real band (for the moment, let's pretend Slipknot actually is), and there probably won't be a CoqRoq CD, there's no legal grounds for anything here. This does fall under parody. Even if the BK band was real, in order for there to be copyright infringement, there would have to be a deliberate attempt to confuse the record buying public into buying CoqRoq but thinking it was Slipknot. I know many Slipknot fans aren't going to grow up to be doctors or scientists; in fact, I'd be surprised if 50% of their fanbase made it to age 18 without eating a fatal amount of Elmer's paste, but they're not going to think CoqRoq is Slipknot, and then buy a CoqRoq CD. No lawsuit, just a bunch of red faces under a bunch of dumb masks above a pair of giant pants.

I remember laughing about how pissed off Slipknot was going to be when the commercial came out. I agree with Gruesome...there's no case here because no "reasonable person" would buy into the CoqRoq as Slipknot. Even if it were, parody has been ruled on many, many times by the Supremes (Court...gotta explain everything here).
Not a big Slipknot fan...song here and there at the most. That being said, Burger King is the worst shit I've ever consumed. This ad campaign just proves their PR department is no better than their crappy cooks.

I bought a few albums based on the user ratings on this site, the latest one being Nevermore...THEY COULDN'T SUCK SERJ'S LEFT BALL, they are talentless fucks.
And don't get me started on those marble-mouthed weak-ass excuses for bands like Arch Enemy, Naplam Death and Lamb of God. They can't sing, the music for many of these groups isn't bad, but they just can't put the two together. It ends up sounding like crap.
Ok, so you like it hard (in the ass, I'm sure) and don't want to listen to anything (so-called) watered-down, but you really all need to get over yourselves. None of you have the talent that SOAD or Slipknot has...none of the bands you listen to have the talent of those two groups...so enjoy them or shut the fuck up.
"Slipknot CD = $4.00 bargain bin" ...hmmm, that's a bargin, but at least Slipknot's getting 4 bucks per used CD...your groups are in the .25 cent bin, if the record store would even buy one of them back.
Now, I don't want to make this a popular vs unpopular (underground) arguement, since SOAD selling over a million copies of their album can't touch some of those pop bands in sales. I personally don't listen to Justin Timberlake, but I respect his talent even if it's not my kind of thing.
You all need to grow up and quit posting bullshit on these message boards. I mean, why even post on an SOAD or Slipknot board if you don't like them. You certainly aint going to sway me, and I gave your groups a chance...they suck...PERIOD!

After reading the affadavit, it's pretty clear that Slipknot are in the right. Has this world gotten so pathetic that you can't come up with 6 rather original twists on chicken masks??? Apparently so, since BK and co felt the need to basically rip off 3 of the masks from the knot. Also somewhere in there it pretty stated that Slipknot weren't ever contacted, and then the next line down it balantantly said they were one of several bands contacted at the time. Surely with all the nu-metal that's out, they could have modeled this "coq roq" bs after something a little more original.
I understand the similarities between 'Knot, Mushroomhead, Gwar...blah blah blah...but still, BK and co could've put some extra thought into it.

i listen to different types of metal, from BLS to Darkthrone, from Iron Maiden to Severed Savior,from Exodus to King Diamond..whatever. but Slipknot's music never appealed to me, not a bit. their music sucks I.M.O. some people like it, i never have and probably never will, i think they are not even near a great metal band...but i heard good things about their live shows, can't judge that because i've never attended one, saw them once on tv when they performed on Conan o brien. and people who say only young kids listen to them need to open their eyes, i see people older than myself buying their albums.

A lot of people are saying they like coq roq better than slipknot. Maybe the whole plan was to get slipknot haters to buy the fries to piss off slipknot? Conspiracy. Does slipknot have their masks/images trademarked or something? Wouldn't they have to , to have grounds for suing? I read this news when I was at work today (I work in advertising oddly enough so this kind of struck me funny). First of all, if this threat to sue is for real, it has the legs of a paraplegic. As said before, it's a parody, there's no direct Slipknot correlation, and it looks like Gwar anyway.
I did, however, get a mean hankering for chicken fries. Never had them, but I wanted to see what all the hype was about. Got 'em on the way home from work-phenomenal. Chicken fries blow coq roq and slipknot off the stage. Maybe one of the worst things you can eat-it's not a fry, and it doesn't really smack of chicken either-but shit, that was some fine dining.

The point is this thread is about Slipknot and there are guys in here posting how Slipknot sucks. I see the same things on the SOAD threads and it makes me wonder...WHY?
My post that SOAD and Slipknot are much better (in my opinion) then Nevermore or the others I mention stands...you can't argue what I like.
I don't read the Nevermore news, I don't care about them...they could fall off the face of the earth and I would't lose a second of sleep. But I did give them a shot, I read the reviews, and one of the threads before I bought the album and I'm sorry, I just don't get it. It's very non-musical, it's very blah.
But again, I don't go to the Nevermore news groups and post NEVERMORE SUCKS!!!, they blow monkey farts...blah, blah, blah.
So why are others doing it in these threads...I just don't get it. It seems like a bunch of children who have nothing better to do than to bash a group because they sell more albums.
My point about Justin Timberlake was missed too. Compared to him or say Spears, Spice Girls, Janet Jackson, etc... SOAD are very underground... I mean they sell Millions upon Millions of records and Mezmerize is about about 1.3 mill sold. Sure, compare that to Nevermore who probably will be lucky to sell a quarter million copies...yeah, they are more underground...
But who the fuck cares. Don't listen to SOAD or Slipknot if you don't like them. Fuck, Metallica is the biggest metal group in the land and they haven't had a good album since the "Black" album. And some hardcore fans won't even give them that one, they stop at MOP or AJFA. Point being, I loved Metallica back in the day, they changed their style and now I don't like it, but Millions more people do...so did they sell out. SURE... Would you sell out....FUCKIN-A YOU KNOW IT.
That would be like saying, whatever job you do right now, you have a bunch of people that love your work and that you get along with. But you are only making 30 thousand a year doing it. So the front office says "We want to make you a manager and pay you 60 thousand a year, what do you think" 95% of you would take the job, the 5% that wouldn't are too scared to take it probably because they are really not doing as good of a job as it appears, but they are good at taking credit for other people's work.
Anyway, this is getting off topic, I just wish the kiddies who post this useless crap would just stop. I end up wasting time like this that I would rather spend doing something more productive.

One thing I didn't mention in my illiad is that I do think it's fucked up that Slipknot would sue. I mean, they stole from MH, who stole from GWAR who stole from KISS etc... who cares, everyone does it and it's not like BK called the group WindsorKnot, Doughknot, or BalloonKnot, and when I saw the comerical the first time, I thought it was pretty funny. I didn't think of Slipknot.
The other messed up thing about this is... this kind of promotion is good for the Metal Community...you want more Nevermore records sold... this could help. Everywhere you look POP music is used to sell everything... A few years back, I remember a push to use more classic stuff like The Who and now maybe it's Metals time.
Slipknot should just roll with it.

Can you believe that a band would get this upset over a Burger King commercial?
Seems to me, if I was in a famous band and Burger King was parodying my band's style in a humorous and non-threatening manner, I would be flattered and amused.
The band and their management should relax and let this campaign run its' course. Slipknot is a household name and this commercial reinforces that idea. Remove the broomsticks from each other's asses now.

Did any of you actually read the transcript before posting?
It actually makes sense why they are doing it. The first paragraph of the second page tells you the reason.
Personally I never saw the connection, and I thought they looked more like Gwar, but when you go to the site and read some of the stuff, it does resemble Slipknot a little bit.

Slipknot declined and this is the ad agency's way of getting back at Slipknot for not selling out to some stupid fast food chain. Regardless of how few similarities there are between Coq Roq and Slipknot, it's no coincidence that a year ago, these guys were turned down by Slipknot when they asked them to appear in their commercials.
BTW, is there any band that every Blabbermouth message board user likes? Every time I look at the comments, somewhere in the first 10 responses will be some Einstein telling me how the subject of the article's band is crap and "not metal".....hilarious.

First of all, this is my first post here and maybe my last.
Second, I'm from Des Moines and I know a little about the situation. The band didn't know that BK wanted them for a commercial, no one told them. And no one told them there would be a lawsuit filed. They were completely in the dark on that one. And I know at least 1 band member that thinks this lawsuit is bullshit...
Third, Talk smack about Slipknot all you want. That's cool. But trust me, those dudes can play, flat out play. I know you can't really tell from the CD's but they can shred with the best of them...

all right man i do agree whit you lamb of god in flames mudvayne etc. are all fucking good band in deed but what i like about slipknot is that they play a kinda music that nobody else can play and joey jordison is probably the best fucking drummer on earth man just watch the disaster peice dvd and you'l understand dude they fucking own the stage man you are probably to scare to go see a slipknot cocnert anyways so if you dont like slipknot man you can kiss my fucking white ass man

I like how all the haters here claim to be true metal fans and claim they like bands like slayer and shit. No doubt they read a metal magazine now think they are metal. Its all good kids. And I saw someone post a line stating bands that are real metal and one name was Mudvayne. No doubt they are fucking awesome too but they are just as nu-metal as slipknot is. And if this was about Mudvayne suing Burger King, the loser who posted that comment would be bashing Mudvayne cause like other haters they are just posers and jump ship to try to fit in. Slipknot sounds awesome to me and millions of others. If you don't like them, stop listening to them then. I mean you must have no common sense if you can't. And obviously you can't cause you're obsessed with bashing them on here. Slipknot has been on the Main Stage of Ozzfest and fucking kicked ass. And if you were there try saying slipknot sucks there and you'd get the fuck beat out of you by everyone. You'd be bruised and left crying in your hoobastank t-shirt. But like I said to the haters there...Its all good little ones. Everyone has a favorite band and is entitled to their own opinions. But kids, it's alright, I know you like to claim to like bands like slayer, black sabbath, iron maiden, etc, all the old school heavy bands cause they are the most well known. But just you bash new metal bands and claim to like the old metal bands, deep in your heart, you're still pop. So be true to yourself and listen to the backstreet boys. Most might not understand this and post bash comments about this. Just cause it's over your head you just can't put the big words together...I understand. Leave metal to the ones who actually listen to it instead of pretending to like it. Hahaha, ahhhhhhhhh you kids and your comments slay me. Keep'em coming.

hey Kommisar Vlad I. Lenin, you put my name in your subject line...that is just so sweet. You do however sound a little cranky. Did you take you nap? or did you doodie in your pants again? Well kid, its very cool you know now to create cool insults like "shitknot" and "Mudass". Very creative. Like I said everyone has the right to their own opinions. Yet you still insist on claiming slipknot sucks. Well of course they suck to you cause their songs involve complex words and melodic melody, which you couldn't possibly comprehend. Damn there i go using another big work you don't understand. Okay the word "comprehend" means to understand. Don't worry, with a little more education you'll pick it up. But in the meantime, you keep on wearing metal band t-shirts and insulting bands with your oh-so-cool combo words like "shitknot" cause eventually you'll see you just can't hang with true metal heads. But I hate to discourage young kids, so you keep on trying to be metal okay. But during conversations with real metal heads, try to reference newer bands instead of the old Slayer, Ozzy, Maiden and etc., not that they are bad or anything, but c'mon now, always stating the well-known metal bands as the best , they're gonna catch on youre just a poser. To eternallygay: Mayhem kills Shitknot, because they're more talented and dark than Shitknot can ever dream of being. They AREN'T a good live act, I've seen them (I went to see Slayer) and they act really fucking stupid, as usual. "Kommisar Vlad I. Penis?" I though you were too "mature" for that type of humor. I used to review metal bands for a campus newspaper and heard some good shit bout them, but never actually heard their CD. But if you guys say they rock, i'll check them out. Thanks for the heads up. yeah tyler you really should get de devil driver cd's man they hare fucking hardcore i personoly like better the first one but the last one is kick ass to those musician are fucking incredible and thats what i like about that band cause dez took somme non popular people but gonna make them popular for sure.
