DIMMU BORGIR Accuses German Rapper Of 'Stealing' Band's Music

According to Bild.de, Norwegian symphonic black metallers DIMMU BORGIR are threatening to sue German rapper Bushido for allegedly using the melodies from DIMMU BORGIR's songs on his albums without permission. DIMMU BORGIR manager Yvette Uhlmann stated: "The band was contacted via the Internet and was told that Bushido had stolen the melody of their song 'Mourning Palace' and that he used it in his song 'Mittelfingah'. Since we were not contacted by Bushido through proper channels and told about his desire to do this, it is clear that Bushido has seriously infringed our intellectual property rights." DIMMU BORGIR is now seeking compensation from Bushido and will file a lawsuit against the 29-year-old rapper if the two parties fail to come to an agreement. DIMMU BORGIR guitarist Silenoz is quoted as saying: "If the German rapper in question does not agree to compensate us adequately, we will sue him! Whoever crosses us will face serious consequences." Lawyers for DIMMU BORGIR and Bushido are currently negotiating a possible settlement. Bushido has declined to comment on the case. Although only one track from DIMMU BORGIR is mentioned in the Bild.de article, there are in fact two songs from each artist that are at the center of this dispute. stupid argument. the notes are clearly different in comparing the first two songs. dimmu borgir and this rapper suck equally as bad in my eyes (and ears).

Those old enough will remember that Dimmu did exactly the same thing themselves. "Sorgens kammer" from their debut album turned out to be a rip-off from an old computer game ("Agony intro"). This is widely known and the reason why the remake of "Stormblast" doesn't feature the same music.
This is what the original composer of THAT song says, pretty amusing:
On a final note, Tim goes on to say, "If you'd like to hear a cover version of the ['incorrect'] Agony Intro theme, then get hold of a copy of Stormblast (1996) by Dimmu Borgir. There's a track on there called "Sorgens Kammer" and it's a blatant rip-off of my music. I have contacted them, but they just give me excuses, and it's not worth suing them for the pennies I'd get back - oh well, life sucks!"

Not quite what I had in mind to say... but yeah. I can't stand all these rap 'artists' (and I use the term loosely) taking good songs and throwing them to the general public who has NEVER heard the original. I played Crazy Train in my car the other day with some friends and the youngest of the group said "Hey! I recognize this! [rappers name] did this one, right?" .... -.-

Yeah its pretty clear this rapper is ripping Dimmu off, though only one riff of eachs ong because each song IS only one riff
as far as "Sorgens kammer" was concerned, blame dimmu's old keyboardist, since its a keyboard only piece that the rest of the band was unaware was stolen. Its not like that piece defined the album or anything too, unlike this rapper who seems to have taken all of his shit from dimmu

Blatant rip-off. Obviously just ripped straight from a midi track (possibly guitar pro/or similar software) and then transposed into a different key in both cases. So 'Meshuggahhailmeshuggah', either go back to your polyrhythms, or truly listen! Dimmu are an awesome band, and very talented musicians. If I was being ripped off i'd want compensation. And come on....who really gives a flying fuck about a poxy computer game that nobody has ever heard of? Suck my balls

Wow, it's pretty obvious for the Mouning Palace song... Dimmu Borgir is so a good band, and people like Bushido are stealing their music just to get better! But you know what? YOU CAN'T. Dimmu Borgir is the best fuckin band.Period.

For the record: all music of which is considered"public domain" if its composer died at least 80 years ago. If you want to use that music, you're free to do so.
Judging from the quality of the rap songs, Dimmu won't be likely to receive a lot of royalties anyway, since no-one will by the crap.

do you know how big bushido is in germany? he's the biggest german rap artist ever and sells thousands of records - so i guess, if dimmu win that case they will receive some money for sure. an besides that - if this isn't good promotion, i don't know what is: the newspaper bild is the biggest newspaper in germany and they got into it without even paying for it. nuclear blast will have a loud laugh about this one! haha

Almost all rappers are morons. Guys, please give him the benefit of the doubt, because he just doesn't know any better. He's just a stupid rapper.

You know, it's really fucking hilarious to me when people use a blanket statement like "rap sucks" and then turn around and say they were listening to Crazy Town in their car, or they like bands like Biohazard, Limp Bizkit, Linkin Park, P.O.D., Papa Roach and all those other fucking nu-metal bands. death / gore / grind bands sample from media all the time, usually without permission, and no one ever seems to care. That includes sound clips from movies as well as artwork for their album covers.
I guess as long as something stays underground, then nobody cares, but the minute somebody makes a few bucks, then it's time to bust out the lawyers!

Classical music (written hundreds of years ago) is in the public domain. Yngwie rips composers all the time. I can take a theme from say Paganinni's 2nd caprice and write something around it and it wouldn't be considered stealing because of the PD. It's morally correct to state that it's a variation on a theme, but it's not necessary. Composers ripped each other back in their day, but called it "variation on a theme".
Rappers on the other hand should all be lined up in the parking lot and shot for using ANY metal music in their songs.

But I'm pretty sure this sucks. Yeah, he might be popular over there in Germany, but then again, so was David Hasselhoff. Nothing against Germany, but some of the music there is just... um... off. To put it mildly.
Sampling is done in rap, yes. But not like it used to be. The rules have changed over the years regarding samples once rap became popular and successful, the latter being the more important issue, particularly to record labels and/or rights holders (which isn't always the band or label).
If you're going to sample, fine. Go for it. But do it the right way. As already said, the more popular or successful you are, the more eyes (and ears) are going to be pointed in your direction. And we live in a lawsuit happy society - it's not just the in the U.S., although we certainly will sue over just about anything. So, just limit it to the music industry here and the suits will send their lawyers out like flying monkeys at will.
Of course, as seen above, some will see any action as proof positive of selling out or being greedy. And that's missing the point.

You actually do NOT need to seek permission to use someone's track like this. You just have to get a mechanical license and pay them the statutory rate, and then write in the cover who the composer was. Do you think everyone who ever recorded a cover song went and sought permission first? No!

I can think of three other people in that band that need to be mentioned six or seven times before Ozzy even gets a footnote. All the motherfucker did was sing, and not even that well. Bill Ward wrote his lyrics for him! Yeah, he was a part of the invention of heavy metal in much the same way that a housekeeper is part of the family.

i don't think ozzy should be underrated but also not overrated. the most stuff he did within the past few years was pretty much crap - no doubt about it, but everything he spent his voice for still is awesome wether it be Sabbath or his solo stuff.
but fuck that - this should be a discussion about "germans" stealing norwegian music... haha

For "christ" sake, you don't seem very kvlt ;) It does suck to find someone has stole a piece - even a small sample - of your own music and is making more money off of it than you are. The original artist probably spent hours upon hours composing their own material, and then make hardly any money off of it. Years after its release, he/she/they find that someone else has stolen a part and is making x times more than what the original composer made. That's a big slap in the face.
As for the whole "Sorgen's Kammer" bit, I feel for the original composer. Stian completely stole the piece and did a poor job about it (as stated in a previous post)! Who knows though. Maybe Stian didn't steal it. Maybe he did compose it and it coincidentally was almost exactly the same. A lot of musicians follow common chord progressions - which leads to some people accidentally using the same exact progressions as previous composers.

A little Profil: Bushido is the most famous rapper from europe and the both tracks are very old, special "mittelfingah" is from today's view very bad, its from 2001, from a time bushido was unknown. He has improves today. Last Tuesday he won a EMA in the second year of follow.
