Australian Teenager Charged For Wearing 'Blasphemous' CRADLE OF FILTH T-Shirt
- June 24, 2008
|
|
Australia's Herald Sun reports that a Gold Coast teenager has been charged by police for wearing a blasphemous t-shirt degrading Jesus. The boy, 16, was stopped by police in Biggera Waters after he was spotted wearing a t-shirt which claims "Jesus is a Cunt" and depicts a nun masturbating. It is a t-shirt for English extreme metal band CRADLE OF FILTH. The teen was charged with offensive behaviour under the Summary Offences Act 2005 for public nuisance on Monday. The incident has sparked debate about Australia's lack of a Bill of Rights. Sen-Sgt Arron Ottaway defended charging the teen. "I'm not religious but that's just offensive,'' Sen-Sgt Ottaway said. Police conducted inquiries at Australia Fair shopping centre, where the teen said he bought the shirt, to find any shops selling it. Read the entire article from Herald Sun. Metro newspaper reported in October 2005 that a British teenage heavy metal fan had been handed a community service order for wearing the CRADLE OF FILTH "Jesus is a Cunt" t-shirt. Adam Shepherd, who was 19 at the time, was reportedly convicted under the then-new anti-hate laws which ban people from displaying religiously insulting signs. The teenager was arrested after a woman complained to police when she saw his shirt, which shows a picture of a nun in a pornographic pose. The top was being worn by Shepherd's girlfriend when a police officer approached her. As soon as the teenager realized there was a problem, he told the officer it was his and swapped tops with his girlfriend. But he refused to take it off or cover it up and was arrested. Shepherd, who bought the shirt in his hometown of Weymouth, Dorset, admitted the charge. Weymouth magistrates gave him 80 hours community service and told him to pay £40 costs (approx. $71 at the time). Meanwhile, MediaWatchWatch.org.uk reported that the wearing of this T-shirt has led to at least two previous convictions in the UK. Dale Wilson, 35, of Norwich, was arrested by two police officers as he walked to the newsagents on Halloween 2004. He pleaded guilty to "religiously aggravated offensive conduct." He was eventually discharged and told to "grow up." He paid £150 costs (approx. $266), and the judge ordered that the T-shirt be destroyed. Back in 1997, Rob Kenyon, 29, of London was found guilty of committing the offense of "Profane Representation under the 1839 Act" by Bow Street Magistrates Court. He was fined £150. CRADLE OF FILTH drummer Nicholas Barker was also arrested in Dover and charged with "creating a public disorder" for wearing the same t-shirt. There were no further proceedings against him. From the NME: In 2001, the then-Lord Provost of Glasgow, Alex Mosson, campaigned to have the t-shirt prevented from being sold at Tower Records. The record shop was raided on two occasions by police, and eventually agreed to stop stocking the garment. The Catholic League of America, back in 1998 (amusing "Victory for Sickos" story) and 1999 (their call to action), also complained bitterly about the t-shirt.

If the cops even try to arrest me i'll give them a lecture on freedom of speech and a right to express ones own opinions.
What if someone wore a 'Criminals are Cool' t shirt or somethin? Does that give the police an excuse to arrest that person also?

I can understand the masturbating nun being a problem, but the Jesus thing? Please.
This religious "sensitivity" bullshit is just another way for religion to control people. Looks like the Australians fell for it, too. At least Denmark has some balls when it comes to free speech-- when Muslims were bitching about those Muhammed drawings, they simply reprinted 'em.
But no, people are too scared because they think some asshole fundamentalists are gonna blow shit up. Which they might.... but who is in the wrong here: the guys who draw pictures, or the guys who murder?

So you believe in freedom of speech, unless it's something you don't like? The Chinese government could use people like you.
The fact that he is an attention-grabber is irrelevant. Should we arrest chicks who have "juicy" written across their asses? Tell you what... let's just arrest anyone who does anything we don't like. It will be cool, just like Zimbabwe.

Sorry guys, but the Australian Constitution does not have any provision relating to freedom of speech, and we never have. While i think this is total cr*p, and nobody seems to mind trendy types wearing shirts about anal sex, or hip hoppers glorifying drive-by shootings, i seriously think the only reason he was arrested was because of the size of the text.

I'm Australian. Our laws are pretty all over the place and most Australian's will agree. They just put a lockout after 2am in Melbourne which means if you're not in a club at that time you have to stay on the streets - this is supposed to STOP street violence apparently. They also banned 'mixed drinks' in bottles at bars. So if you want a lolly drink you can't get one when you're out you have to pay premium for the bartender to make it up for you - these are all new laws in the last couple of months.
Sucks pretty bad.
However, the tshirt I reckon is pretty far, not worth being arrested for but common sense tells you it's pretty offensive. In my opinion they should be spending more time arresting real criminals that guys wearing tshirts but hey, what can ya do

Its shit like this that makes me think that Australia is just a mass-manufactured product of the government and church. Points:
1. No said Bill Of Rights; we don't even have freedom of speech for fucks sake... I could get arrested for making a statement that promotes terrorism or blasphemy 2. I'm a gamer, so I get pissed off that we ban every game that exceeded MA15+... we have to get half of our awesome games edited before they hit our shores 3. The government can stop bands from getting a temporary visa if they think that they are "unsociable"... okay, so the whole Snoop Dogg getting banned from Australia was funny, but they tried to ban Cannibal Corpse and Mayhem from hitting our shores... 4. We cower in fear whenever we do something to upset a minority group... for fucks sake, if they don't like our culture, then they should leave, simple... you don't stick around in Japan if you can't get along with anyone or learn the language 5. This isn't even that offensive... those shirts have been around for year... why they haven't done anything up until now surprises me
So in short, it sucks to be Australian for alot of reasons. Although we will always have our Bundaberg Rum and AC/DC

Remember this is the same fucking country that forces it's own citizens to vote in all major elections regardless of whether you want to or not. Or face a hefty fine or jail time. For example, parents do not want their young kids to see the shirt and learn a new swear-word.
The picture on the front of the shirt is sexually explicit also and you can't show that to minors.

Anyway, I guess I never realized that Australia doesn't have the right to Free Speech. In all honesty, I doubt the realities of that are much different than the "Free speech" here in the States, ours mostly applies to political speech. Obscenity laws still put a squash quite a bit (I'm sure there are many places in the states where I kid would get arrested for this same shirt).
Regardless, Australia is one of my favorite places. I spend a couple of weeks there every year, everybody there is so damn friendly and laid back. Always a good time.

Essentially, no. If it said "Smith" instead of "Jesus", it would still be inappropriate.

I was born there but i've been livin in cairns for most of my life...
mate i went to a catholic high school (only cos everywhere else was shit) where a few people basically said we were one of the most secular countries around and that catholicism should be more integrated into everyday life...
compulsory religion in primary schools? is that a state primary? ive was sent to catholic schools so of course it was compulsory (again only because all the other state, anglican etc schools were shit supposedly)...
my girlfriend doesnt give me problems mate its more the parents (father) who arent too thrilled...

Thats true about the fines mate. I understand that if you don't want to vote you shouldn't have to vote, which i assume is what you're aiming for in america (you are american right?). But if you don't vote then you shouldn't really complain about the actions of politicians, because you could have helped to kick them out. Our system ain't perfect, but it eliminates that.
The kid wouldn't have been arrested for blasphemy, theres no really crime for blasphemy here, i dont think. As for the other things that you mentioned that is also true, but not quite as errr unsubtle (excuse the grammar)
He wont be charged for slander against jesus, just public obscenity, the same as if he dropped his pants in the middle of a shopping centre
as for the whole civil liberties things, we're not too bad, not perfect by any stretch but then who is?

My apologies.... I bow to your obviously outstanding scholarship...
I mean obviously an American such as yourself would know more about Australia than an Australian like myself....

It has happened before and it will sure as hell happen again at some point in the future.
What many people dont seem to be able to grasp is that stories like these, of teens getting arrested for wearing the Jesus shirt, end up as great free advertising for the band, and also makes the SHIRT itself more desirable to young metal fans who want to get a reactions from the "normal" people.
I will hold my hand up to owning this shirt, however, it only ever sees the light of day on some of the occasions i go to see COF live, and then out of respect for people i may encounter on my way to or from the gig who do not understand that it is a BAND shirt , i wear a jacket unless I am inside the gig venue. It is not a shirt i would wear just for the hell of it to go to the shops.
Though to be honest the Jesus shirt is not the only shirt Cradle have produced using religious imagery...
"The F**king priest deserved to die" - theimage of Les (ex keyboardist) in his priest outfit murdered on the front "Decadence is a virtue" - had half naked nuns on the front over the naked body of a woman "Get the behind me satan" - a woman being shagged from behind by satan "Touched by Jesus, fingered by god" - nuff said
I know there have been others over the years but cant remember them off the top of my head right now I have been a fan of Cradle for 12 years now, and have a stupid number of cradle shirts hanging in my cupboard....one of the first i bought was the "...priest deserved to die" shirt from the Cruelty and the beast era
in past interviews the band themselves have said they pretty uch do them for the reaction they get, and Dani never thought he could best the Jesus shirt but if he can he will.
at the end of the day, love em or hate em, Cradle will always be a band who will provoke a reaction from people either by their music or their merchandise. Any reaction, newspaper story or internet article or whatever ends up as FREE advertising for the band

I think the kids should've got let off. It's just a shirt, a quite amusing one at that. Yes people find it offensive but people also find other things offensive such as supre clothing but you dont see cops pulling little chilren up for dressing somewhat skanky and obscene. What if it was a tattoo that had that same slogan, What would happen then?

I can't even count the amount of times I have worn that shirt near cops and they haven't even given me a second glance...
Maybe it's what my dear old mum used to tell me "it's not what you wear, but how you wear it"?
Maybe the guy was just being a wanker lol, or at least looked like on :P
